This instrument, made this ff day of December, 2004, between Eric H. Lindquist, a
<br />member of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ",
<br />pursuant to a power of sale contained in that certain Deed of Trust recorded on June 7, 2002 as
<br />Instrument No. 0200206123 and re- recorded on August 14, 2002 as Instrument No. 0200208546 of
<br />the Mortgage Records in the office of the Register of Deeds of Hall County, Nebraska, and Federal
<br />National Mortgage Association, hereinafter called "Grantee ". This Corrective Trustee's Deed is
<br />being filed to correct the Grantee identified on the Trustee's Deed recorded October 4, 2004 as
<br />Instrument No. 0200409745 of the Deed Records of Hall County, Nebraska which incorrectly
<br />identified Union Planters Bank N.A., successor by merger to Union Planters Mortgage, Inc. as the
<br />Grantee.
<br />WHEREAS, on July 6, 2004, Eric H. Lindquist, as Successor Trustee, executed a Notice of
<br />Default pursuant to which notice was given to Jimmy H. Kee, a single person, Trustor, under that
<br />certain Deed of Trust recorded on June 7, 2002 as Instrument No. 0200206123 and re- recorded on
<br />August 14, 2002 as Instrument No. 0200208546 of the Mortgage Records in the office of the
<br />Register of Deeds of Hall County, Nebraska, covering that certain premises described as:
<br />Lot One (1), Dodd and Marshall's Second Addition, in the City of Wood River,
<br />Hall County, Nebraska,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on July 8, 2004 as Instrument No. 0200406740 of the Miscellaneous
<br />Records of said County.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on August 19, 2004, Grantor caused to be published in the
<br />Grand Island Daily Independent, a newspaper having a general circulation in Hall County,
<br />Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and stating
<br />that the described property would be sold at public auction to the highest bidder for cash or certified
<br />or cashier's check, at the lower level lobby of the Hall County Courthouse, lst & Locust Street,
<br />Grand Island, Hall County, Nebraska, at 2:00 p.m. on September 29, 2004. Publication of such
<br />notice was made for five consecutive weeks on August 19, 2004, August 26, 2004, September 2,
<br />2004, September 9, 2004 and September 16, 2004, the last publication being at least ten (10) days
<br />but not more than thirty (30) days prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76 -1008
<br />R.R.S. Nebraska.
<br />Pursuant to said Notice of Trustee's Sale, John B. McDermott, attorney for Eric H.
<br />Lindquist, Successor Trustee, did at the time and place mentioned in said Notice of Trustee's
<br />Sale, offer said property for sale at public auction, and did sell the same to Union Planters Bank
