<br />HOMESTEAD DESIGNATION DISCLAIMER

<br />In accordance with the provisions of the Nebraska Farm Homestead Protection Act,
<br />Neb. Rev. Stat. Sections 76 -1901, et seq., as a preface to the execution, and as a part of the
<br />following Deed of Trust, the undersigned Trustor being first duly sworn, elect to Disclaim the
<br />Right to Designate a Homestead.
<br />We disclaim the right to designate a homestead on the property described in the
<br />following Deed of Trust. No part of our homestead is presently, or in the future will be, situated
<br />upon said real estate. We understand that if we establish a homestead on any part of the real
<br />estate during the time the Deed of Trust remains unsatisfied and a lien on the real estate, we
<br />shall have no right to make a designation of homestead in the event of a Trustee's sale or a
<br />foreclosure sale.

<br />THIS DEED OF TRUST is made as of the `/ day of December, 2004, by GARY D.
<br />LUHN and KATHIE L. LUHN, husband and wife, jointly and severally, ( "TRUSTOR "), whose
<br />mailing address is: 7001 N. 150th Road, Cairo, NE 68824;
<br />and, DUANE A. BURNS, ( "TRUSTEE "), whose mailing address is: 308 N. Locust Street,
<br />Suite #306, Grand Island, Nebraska 68801;
<br />and GERALD D. LUHN, single, ( "BENEFICIARY ") whether one or more, whose mailing
<br />address is 5175 North Cameron Road, Cairo, NE 68824.
<br />FOR VALUABLE CONSIDERATION, Trustor irrevocably transfers, conveys, and
<br />assigns to Trustee, IN TRUST, WITH POWER OF SALE, for the benefit and security of
<br />Beneficiary, under and subject to the terms and conditions of this Deed of Trust, the real
<br />property located in Hall County, Nebraska, and legally described as follows: (the "Property "):
<br />An undivided one -half interest in the Southwest Quarter (SW1 /4)
<br />of Section Twenty Three (23), Township Twelve (12) North, Range
<br />Twelve (12), West of the 6th P.M., Hall County, Nebraska
<br />together with the house, garage and all other improvements thereon.
<br />TOGETHER WITH all rents, easements, appurtenances, hereditaments, interests in adjoining
<br />roads situated thereon.
<br />The property and the entire estate and interest conveyed to the Trustee are referred to
<br />collectively as the "Trust Estate ".
