200411564 <br />LOAN #: 04- E63141 <br />PREPAYMENT RIDER <br />THIS PREPAYMENT RIDER is made this 22ND day of NOVEMBER, 2004, <br />and is incorporated into and shall be deemed to amend and supplement the Mortgage, <br />Deed of Trust or Security Deed (the "Security Instrument ") of the same date given by <br />the undersigned (the "Borrower ") to secure Borrower's Note to NOVASTAR HOME <br />MORTGAGE, INC., A CORPORATION <br />of the same date and covering the Property described in the Security Instrument and <br />located at: <br />4261 LARIAT LANE <br />GRAND ISLAND, NE 68803 <br />PREPAYMENT COVENANTS. In addition to the covenants and agreements <br />made in the Security Instrument, Borrower and Lender further covenant and agree as <br />follows: <br />I have the right to make payments of principal at any time before they are due. A <br />prepayment of all of the unpaid principal is known as a "full prepayment." A prepayment <br />of only part of the unpaid principal is known as a "partial prepayment." I will notify the <br />Note Holder in writing that I am doing so. <br />During the first TWENTY FOUR ( 24 ) month(s) of my loan, I will <br />be charged a PREPAYMENT PENALTY in an amount equal to six (6) months' interest <br />(at the rate in effect at the time Prepayment occurs) on any Prepayment I make in excess <br />of twenty percent (20.000 %) of the original principal balance in any twelve (12) month <br />period. Thereafter, I may make full Prepayment or partial Prepayments without paying <br />any prepayment charge. <br />The Note Holder will use all of my Prepayments to reduce the amount of Principal <br />that I owe under this Note. If I make a partial Prepayment, there will be no changes in <br />the due dates of my monthly payments unless the Note Holder agrees in writing to those <br />changes. [If this Note provides for an adjustable interest rate, my partial Prepayment <br />may reduce the amount of my monthly payments after the Payment Change Date if my <br />partial Prepayment occurs prior to the Payment Change Date.
