<br />Connie S. Peters, being first duly sworn, deposes and says:
<br />1. That the Affiant is the successor trustee of the Harold
<br />F. Schuett and Helen M. Schuett Revocable Trust dated June 24, 1989
<br />(hereinafter referred to as the "said Trust ").
<br />2. That on September 10, 2004, the Affiant became the
<br />successor trustee of the said Trust upon the death of Helen M.
<br />Schuett, who was one of the settlors and initial co- trustees of
<br />said Trust, and following the death of Harold F. Schuett on
<br />February 13, 1990, who was the other settlor and initial co- trustee
<br />of said Trust. Certified copies of the death certificates for
<br />Helen M. Schuett and Harold F. Schuett are attached hereto, marked
<br />Exhibits "A" and "B ", respectively, and made a part hereof by this
<br />reference.
<br />3. That the Affiant remains the sole trustee of the said
<br />Trust as of this date.
<br />4. That among the assets of the said Trust is the following
<br />described real property:
<br />The West Half of the Southwest Quarter (W ZSW 4) of Section
<br />Twenty -three (23), Township Twelve (12) North, Range
<br />Eleven (11) West of the 6th P.M., Hall County, Nebraska;
<br />and
<br />Lots Four (4) and Five (5), in Block One (1), in the
<br />Third Addition to the town of Cairo, Hall County,
<br />Nebraska.
<br />5. That pursuant to the terms of the said Trust and §30-
<br />2821(2) (g) of the Nebraska Trustees' Powers Act, the trustee of
<br />the said Trust has the power, without court authorization, to
<br />acquire or dispose of an asset, for cash or on credit, at public or
<br />private sale.
<br />6. That neither the said Trust or the Agreement creating the
<br />said Trust, nor any part thereof, has been revoked or amended, and
<br />the above statements constitute a full disclosure of all provisions
<br />concerning those items.
