<br />This instrument, made this _q day of November, 2004, between Eric H. Lindquist, a
<br />member of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ",
<br />pursuant to a power of sale contained in that certain Deed of Trust recorded on October 20, 1998 as
<br />Instrument No. 98- 110267 of the Mortgage Records in the office of the Register of Deeds of Hall
<br />County, Nebraska, and Coad J. Miller and Martina Doetsh, husband and wife, as joint tenants
<br />with rights of survivorship, hereinafter called "Grantee ":
<br />WHEREAS, on August 16, 2004, Eric H. Lindquist, as Successor Trustee, executed a
<br />Notice of Default pursuant to which notice was given to David E. Provost and Diane E. Provost,
<br />husband and wife, Trustors, under that certain Deed of Trust recorded on October 20, 1998 as
<br />Instrument No. 98- 110267 of the Mortgage Records in the office of the Register of Deeds of Hall
<br />County, Nebraska, covering that certain premises described as:
<br />LOT 5, BLOCK 22, CHARLES WASMER'S ADDITION, CITY OF GRAND
<br />ISLAND, HALL COUNTY, NEBRASKA,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on August 18, 2004 as Instrument No. 0200408180 of the Miscellaneous
<br />Records of said County.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on September 27, 2004, Grantor caused to be published in
<br />the Grand Island Daily Independent, a newspaper having a general circulation in Hall County,
<br />Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and stating
<br />that the described property would be sold at public auction to the highest bidder for cash or certified
<br />or cashier's check, at the lower level lobby of the Hall County Courthouse, 1St & Locust Street,
<br />Grand Island, Hall County, Nebraska, at 2:00 p.m. on November 8, 2004. Publication of such
<br />notice was made for five consecutive weeks on September 27, 2004, October 4, 2004, October 11,
<br />2004, October 18, 2004 and October 25, 2004, the last publication being at least ten (10) days but
<br />not more than thirty (30) days prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76 -1008
<br />R.R.S. Nebraska.
<br />Pursuant to said Notice of Trustee's Sale, John McDermott, attorney for Eric H. Lindquist,
<br />Successor Trustee, did at the time and place mentioned in said Notice of Trustee's Sale, offer said
<br />property for sale at public auction, and did sell the same to Grantee for the sum of $58,167.00, it
<br />being the highest bidder therefor.
<br />NOW, THEREFORE, in consideration of the premises and of the sum of $58,167.00 so bid
<br />and paid as aforesaid, I, Eric H. Lindquist, Successor Trustee, do hereby grant and convey unto said
<br />Grantee, its successors and assigns forever, all the estate, right, title and interest of which the said
