<br />This instrument, made this L day of August, 2004, between Eric H. Lindquist, a member
<br />of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ", pursuant to
<br />a power of sale contained in that certain Deed of Trust recorded on September 28, 1992 as
<br />Instrument No. 92- 108360 of the Mortgage Records in the office of the Register of Deeds of Hall
<br />County, Nebraska, and the Secretary of the Department of Housing and Urban Development,
<br />hereinafter called "Grantee ":
<br />WHEREAS, on May 18, 2004, Eric H. Lindquist, as Successor Trustee, executed a Notice
<br />of Default pursuant to which notice was given to Todd A. Guthrie and Jill M. Guthrie, husband and
<br />wife, Trustors, under that certain Deed of Trust recorded on September 28, 1992 as Instrument No.
<br />92- 108360 of the Mortgage Records in the office of the Register of Deeds of Hall County,
<br />Nebraska, covering that certain premises described as:
<br />The Southerly Seventy Eight and Forty Seven Hundredths Feet of Lot Five (5), in
<br />Block One Hundred Twenty -Eight (128) in Koenig and Wiebe's Addition to the
<br />City of Grand Island, Hall County, Nebraska,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on May 21, 2004 as Instrument No. 0200405069 of the Miscellaneous
<br />Records of said County.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on June 30, 2004, Grantor caused to be published in the
<br />Grand Island Daily Independent, a newspaper having a general circulation in Hall County,
<br />Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and stating
<br />that the described property would be sold at public auction to the highest bidder for cash or certified
<br />or cashier's check, at the lower level lobby of the Hall County Courthouse, 1St & Locust Street,
<br />Grand Island, Hall County, Nebraska, at 2:00 p.m. on August 11, 2004. Publication of such notice
<br />was made for five consecutive weeks on June 30, 2004, July 7, 2004, July 14, 2004, July 21, 2004
<br />and July 28, 2004, the last publication being at least ten (10) days but not more than thirty (30) days
<br />prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76 -1008
<br />R.R.S. Nebraska.
<br />Pursuant to said Notice of Trustee's Sale, Michael P. Burns, attorney for Eric H.
<br />Lindquist, Successor Trustee, did at the time and place mentioned in said Notice of Trustee's
<br />Sale, offer said property for sale at public auction, and did sell the same to MidFirst Bank for the
<br />sum of $39,374.98, it being the highest bidder therefor. MidFirst Bank has assigned all of its
<br />right, title, and interest in and to such bid to Grantee.
