200411009 <br />THIS ADDENDUM TO DEED OF TRUST is made this 5TH day of NOVEMBER <br />2004 and is incorporated into and shall be deemed to amend and supplement the Security <br />Instrument. <br />ADDITIONAL COVENANTS. In addition to the covenants and agreements made in <br />the Security Instrument, the Revocable Trust Trustee, Settlor, and the Lender further covenant <br />and agree as follows: <br />A. REVOCABLE TRUST <br />1. CERTIFICATION AND WARRANTIES OF TRUSTEE(S): <br />The Revocable Trust Trustee certifies to Lender that the Revocable Trust is a <br />revocable trust for which the Revocable Trust Trustee is holding title in fee to the Property as <br />trustee. <br />The Revocable Trust Trustee warrants to Lender that (i) the Revocable Trust is <br />validly created, duly executed and in existence, and is valid and enforceable under the laws of the <br />State of Nebraska; (ii) the trust instrument creating the Revocable Trust is in full force and effect <br />and there are no amendments or other modifications to the trust instrument affecting the <br />revocability of the Revocable Trust or the powers of the Revocable Trust Trustee; (iii) the person <br />creating the trust was under no disability or infirmity at the time the trust was created; (iv) the <br />Property is located in HALL County, Nebraska; (v) the Revocable Trust Trustee has full power <br />and authority as trustee under the Revocable Trust and under applicable law to execute the <br />Security Agreement, including this Addendum; (vi) the Revocable Trust Trustee has executed the <br />Security Instrument, including this Addendum, on behalf of the Revocable Trust and the <br />Revocable Trust Trustee knows of no facts or legal claims which might impair the validity of the <br />trust or the validity of the Revocable Trust Trustee's actions herein; (vii) the Settlor, if available <br />and when required by the Revocable Trust, has executed the Security Instrument, including this <br />Addendum, acknowledging all of the terms and conditions contained therein and agreeing to be <br />bound thereby and the Settlor knows of no facts or legal claims which might impair the validity <br />of the trust or the validity of the Revocable Trust Trustee's actions herein; (viii) only the Settlor <br />and the Revocable Trust Trustee may hold any power of direction over the Revocable Trust; (ix) <br />only the Settlor holds the power to direct the Revocable Trust Trustee in the management of the <br />Property; (x) only the Settlor holds the power of revocation over the Revocable Trust; (xi) the <br />Revocable Trust Trustee has not been notified of the existence or assertion of any lien, <br />encumbrance or claim against any beneficial interest in, or transfer of all or any portion of any <br />beneficial interest in, or powers of direction of the Revocable Trust Trustee or the Revocable <br />Trust, as the case may be, or power of revocation over the Revocable Trust; and (xii) Borrower <br />has provided Lender with a complete and accurate photocopy of the original Revocable Trust and <br />all addenda thereto. <br />2.
