200410895 <br />Issuer is unable to present a qualified contract one year after the date <br />the written request was submitted to the Issuer. <br />In the event foreclosure proceedings are initiated, the Issuer shall receive notice <br />of such foreclosure no less than 15 days prior to such foreclosure. <br />iii. Notwithstanding subsections (i) and (ii) above, the Code Section 42 rent <br />requirements shall continue for a period of three years following the <br />termination of this Agreement. During such three -year period, the Borrower <br />shall not evict or terminate the tenancy of an existing tenant of any low- income <br />Dwelling Unit other than for good cause and shall not increase the gross rent <br />above the maximum allowed under Section 42 of the Code with respect to such <br />low - income Dwelling Unit. <br />3. Section 25 is added to the Agreement as follows: <br />Section 25. Borrower Covenant. Borrower covenants that it will not knowingly <br />take or permit any action that would result in a violation of the requirements of Section <br />42, the Regulations or the Agreement. Moreover, Borrower covenants to take any lawful <br />action (including amendment of the Agreement, as may be necessary in the opinion of the <br />Issuer) to comply with Section 42, the Regulations and the Agreement. <br />01- 637879.1 3 <br />
