MEMORANDUM OF AGREEMENT TO ESTABLISH BOUNDARY <br />WHEREAS, the undersigned have a contiguous BOUNDARYto their respective real <br />estate in the Southwest Quarter of Section Twenty Three (23), Township Eleven (11) <br />North, Range Nine (9) West of the 61" P.M., and <br />WHEREAS, said Boundary, being the centerline of the Wood River Channel, has <br />changed due to the meandering of the Wood River Channel, and <br />WHEREAS the old stakes and way points have been lost or destroyed over time, <br />and <br />WHEREAS, it would be to the best interest of the undersigned to establish a <br />permanent BOUNDARY, and <br />THEREFORE, in consideration of the mutual benefit to each party it is agreed as <br />follows: <br />Judith K. Poland will, at herexpense, obtain a survey of the center line of the Wood <br />River Channel as currently existing from the West line of said Section to the North line of <br />Lot Three (3) Island as extended to the center line of the Wood River Channel from a <br />licensed land Surveyor. Upon completion of said survey, each party hereto shall <br />acknowledge said survey to be the mutual boundary line, including all prior accretion lands, <br />between the parties for recording with the Register of Deeds of Hall County, Nebraska. <br />Said acknowledgment shall be accomplished by recording a copy of this <br />Memorandum with the Register of Deeds of Hall County, Nebraska. - <br />This Memorandum of Agreement is intended to be binding upon the parties hereto, <br />jointly and severally, and upon the respective heirs and assigns of the parties. <br />Dated Se tember.
