MEMORANDUM OF AGREEMENT TO ESTABLISH BOUNDARY WHEREAS, the undersigned have a contiguous BOUNDARYto their respective real estate in the Southwest Quarter of Section Twenty Three (23), Township Eleven (11) North, Range Nine (9) West of the 61" P.M., and WHEREAS, said Boundary, being the centerline of the Wood River Channel, has changed due to the meandering of the Wood River Channel, and WHEREAS the old stakes and way points have been lost or destroyed over time, and WHEREAS, it would be to the best interest of the undersigned to establish a permanent BOUNDARY, and THEREFORE, in consideration of the mutual benefit to each party it is agreed as follows: Judith K. Poland will, at herexpense, obtain a survey of the center line of the Wood River Channel as currently existing from the West line of said Section to the North line of Lot Three (3) Island as extended to the center line of the Wood River Channel from a licensed land Surveyor. Upon completion of said survey, each party hereto shall acknowledge said survey to be the mutual boundary line, including all prior accretion lands, between the parties for recording with the Register of Deeds of Hall County, Nebraska. Said acknowledgment shall be accomplished by recording a copy of this Memorandum with the Register of Deeds of Hall County, Nebraska. - This Memorandum of Agreement is intended to be binding upon the parties hereto, jointly and severally, and upon the respective heirs and assigns of the parties.
