WITNESSETH THAT:
<br />WHEREAS, for a valuable consideration on May 13, 2002, J. Reyes Nuno- Lopez, a single
<br />person, Trustor, executed and delivered his Deed of Trust to Michael F. Kivett, as Trustee, and
<br />CitiFinancial, Inc. (MD), as Beneficiary, conveying the real estate hereinafter described in trust, with
<br />power of sale, in accordance with the terms and provisions set forth therein; that said Deed of Trust was
<br />thereafter recorded on May 17, 2002 in the office of the Register of Deeds of Hall County, Nebraska as
<br />Instrument No. 0200205318; and
<br />WHEREAS, the Trustor having defaulted in the payment of the indebtedness secured thereby
<br />and the Beneficiary having delivered to the Trustee a written declaration of default and having deposited
<br />with the Trustee all promissory notes together with Notice of Default; and
<br />WHEREAS, in compliance with Sec. 76 -1006, Statutes of Nebraska, on the 10`h day of August,
<br />2004, the Trustee filed a Notice of Default in the office of the Register of Deeds of Hall County,
<br />Nebraska, as Instrument No. 0200407860, which Notice fully complied with the requirements of said
<br />statute; and
<br />WHEREAS, in compliance with Sec. 76 -1008, Statutes of Nebraska, on the 13`h day of August,
<br />2004, the Trustee mailed by certified mail, with postage prepaid, a copy of such Notice of Default with
<br />the recording date shown thereon, addressed to the following interested parties, to -wit:

<br />Grand Island NE 68801
<br />which mailing of notice fully complied with the requirements of said statute; and
<br />WHEREAS, in compliance with Sec. 76 -1007, Statutes of Nebraska, the Trustee gave written
<br />notice of the time and place of sale particularly describing the property to be sold by publication of such
<br />notice, commencing on September 15, 2004 and continuing once each week for five (5) consecutive
<br />weeks, the last publication being at least ten (10) days but not more than thirty (30) days prior to the date
