200410482 <br />5. Sidewalks. Immediate sidewalk construction adjacent to St. Paul Road and <br />Eilenstine Road shall be waived. However, the sidewalks shall be constructed when the property <br />owner is directed to do so by the City Council. In the event a Street Improvement District is created <br />to pave any public street in the subdivision, the Subdividers agree to install public sidewalks within <br />one year of the completion of such street improvement district in accordance with the City of Grand <br />Island Sidewalk Policy. <br />6. Restricted Use of Property. The use of a 40'x 112' portion of the east side of <br />Lot Two (2), and a 80'x60' portion of the north side of Lots Three (3), Four (4), Five (5) and Six (6) <br />as shown on the plat dated October 19, 2004, shall be restricted for the purpose of providing space <br />for a septic field and a reserve septic field (onsite wastewater treatment system). No structures, <br />paving, fences, or trees are allowed in the restricted area on these lots. The Subdividers must include <br />language in any deed conveying Lots Two (2), Three (3), Four (4), Five (5) or Six (6) that such <br />property contains a restriction on its use. Such restrictions shall remain in place until such property is <br />served by a municipal sewer system. <br />7. Engineering Data. All final engineering plans and specifications for public <br />improvements shall bear the signature and seal of a registered professional engineer and shall be <br />furnished by the Subdividers to the Department of Public Works for approval prior to contracting for <br />construction of any improvements. Inspections of improvements under construction shall be <br />performed under the supervision of a professional registered engineer and upon completion shall be <br />subject to inspection and approval by the Department of Public Works prior to acceptance by the <br />City of Grand Island.
