COUNTY OF HALL ) B. J. CUNNINGHAM, JR., being first duly sworn on oath, deposes and states as follows: 1. That Affiant has practiced law in Grand Island, Hall County, Nebraska, for more than 50 years last past and was well acquainted with John Wortman and his family, who was granted a life estate in and to the above - described property by a Quitclaim Deed recorded in Book 135 at Page 145, and that Affiant knows of his own knowledge that the said John Wortman, life tenant, died in Hall County, Nebraska, on July 24, 1967, and that Affiant attended the funeral of the said John Wortman. 2. That Clement Wortman, Grantee in the Quitclaim Deed described in Paragraph 1 above, and Clement E. Wortman, devisee in a Deed of Distribution conveying an interest in the above property recorded as Document No. 83- 000900, and Clement E. Wortman, whose estate is being probated in the Hall County Court, Estate No. PR04- 139, is one and the same person despite the discrepancy in names. 3. That Elton Wortman, Grantee in the Quitclaim Deed described in Paragraph 1 above, and Robert E. Wortman, devisee in a Deed of Distribution conveying an interest in the above property recorded as Document No. 83- 000900, and Robert E. Wortman, devisee in a Deed of Distribution conveying an interest in the above property recorded as Document No. 200101947, is one and the same person despite the discrepancy in names.
