Debtor further warrants and represents to Secured Party that, except for the security interest <br />granted hereby in the Collateral, Debtor is the owner and holder of the Collateral, free of any adverse <br />claim, security interest, or encumbrance, and Debtor agrees to defend the Collateral against all claims and <br />demands of any person at any time claiming'the same or any interest therein, except rights of tenants to <br />use thereof and subject to the other matters set forth herein. Debtor further warrants and represents that <br />Debtor has not heretofore signed any financing statements in connection with the Collateral and that there <br />are no financing statements signed by Debtor now on file in any public office. <br />F. MISCELLANEOUS PROVISIONS <br />1. Borrower shall not create or permit to exist any liens or encumbrances on the property which are <br />junior and inferior in terms of priority to the Security Instrument, including mechanics' liens and <br />materialmens' liens without Lender's consent. <br />G. TERMINATION OF CONSTRUCTION LOAN RIDER <br />So long as Borrower is not in default under the terms of the Note, the Agreement, or the Security <br />Instrument, and so long as Borrower has completed the improvements described in the Agreement, this <br />Rider shall terminate and shall thereafter no longer be in effect. <br />Page 6 of 7 SMSNDC /0000 /RR080003 <br />
