200410321 <br />Loan No: 0047182795 <br />CONSTRUCTION LOAN RIDER TO SECURITY INSTRUMENT <br />(WITH SECURITY AGREEMENT) <br />THIS CONSTRUCTION LOAN RIDER TO SECURITY INSTRUMENT AND SECURITY <br />AGREEMENT is made this 19TH day of OCTOBER, 2004, and is incorporated into and shall be <br />deemed to amend and supplement the Mortgage, Deed of Trust, or Security Deed (the "Security <br />Instrument ") of the same date given by the undersigned (the "Borrower ") to secure Borrower's Note (the <br />"Note ") to WELLS FARGO BANK, N.A. (the "Lender ") of the same date and covering the property <br />described in the Security Instrument (the "Property") and located at: 4112 SANDALWOOD ROAD, <br />GRAND ISLAND, NEBRASKA 68803 <br />ADDITIONAL COVENANTS <br />In addition to the covenants and agreements made in the Security Instrument, Borrower and Lender further <br />covenant and agree as follows: <br />A. INCORPORATION OF RESIDENTIAL CONSTRUCTION LOAN <br />AGREEMENT <br />Lender and Borrower entered into a Residential Construction Loan Agreement (the "Agreement ") this <br />same date. The Agreement is incorporated herein by reference. Default under the terms of the Agreement <br />shall be default under the terms of the Security Instrument which default entitles the Lender to accelerate <br />the maturity of the Note and to exercise all available remedies. <br />B. CONSTRUCTION MORTGAGE <br />The Security Instrument securing the obligation for the cost of construction of certain improvements <br />on the Property, is a "Construction Mortgage" under the Uniform Commercial Code as adopted and <br />applied in the state where the Property is situated.
