NOTICE OF DEFAULT <br />TO WHOM IT MAY CONCERN: <br />You are hereby notified that Lindsay Rhoads Chavez f/k/a Lindsay Rhoads and Victor H. <br />Chavez, as wife and husband and Lydia Sanchez, a single person, Trustors, did on or about January 22, <br />2003, make, execute and deliver to Michael F. Kivett, Attorney at Law, as Trustee, a Deed of Trust <br />wherein said Trustors conveyed the following described real property: <br />"Lot 9 in Block 67, Wheeler and Bennett's 2nd Addition to the City of Grand Island, Hall <br />County, Nebraska" <br />as security for repayment of a loan which the Trustors, Lindsay Rhoads Chavez and Lydia Sanchez, <br />obtained from CitiFinancial, Inc. (MD), Beneficiary of said Deed of Trust, which Deed of Trust was <br />recorded on January 24, 2003 as Instrument No. 0200300911, Mortgage Records, in the office of the <br />Register of Deeds of Hall County, Nebraska. <br />You are further notified that there has occurred a breach of an obligation of the Trustors for <br />which the trust property was conveyed as security, to -wit, that the Trustors, Lindsay Rhoads Chavez and <br />Lydia Sanchez, have failed to pay the Beneficiary payments which were contractually due on April 28, <br />2004 through September 28, 2004, together with interest accruing thereon. <br />You are further notified that the undersigned Trustee, at the request of the Beneficiary has <br />elected to declare the entire unpaid principal balance, together with interest thereon at once due and <br />payable and has elected to sell or cause to be sold the real property described in said Deed of Trust to <br />satisfy said obligation. <br />Dated this 30`h day of September, 2004. <br />/Nfichael F.
