<br />ASSIGNMENT OF BENEFICIARY'S INTEREST IN DEED OF TRUST

<br />KNOW ALL MEN BY THESE PRESENTS, that PINNACLE BANK ( "Assignor ") for
<br />good and valuable consideration to it in hand paid by TIERONE BANK, ITS SUCCESSORS
<br />AND /OR ASSIGNS, AS THEIR INTEREST MAY APPEAR ( "Assignee "), the receipt of
<br />which consideration is hereby acknowledged, does hereby assign, transfer, and set over
<br />unto Assignee all its right, title, and interest as beneficiary under and in and to that certain
<br />Deed of Trust dated OCTOBER 1, 2004, by and between KIPP R. SMITH AND ELIZABETH
<br />KEAR, EACH A SINGLE PERSON, JOINTLY AND EACH IN THEIR OWN RIGHT,
<br />Trustors, PINNACLE BANK, as Beneficiary, and TIERONE BANK, ITS SUCCESSORS
<br />AND /OR ASSIGNS, as Trustee, covering the following- described real property, to -wit:
<br />LOT NINETEEN (19), IN BLOCK THREE (3), IN OLDIE MILL SUBDIVISION,
<br />CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA,
<br />and filed for record in the office of the Register of Deeds of HALL County, Nebraska, on the
<br />day ofrbt„� , 2004, and appearing of record at Book Paged y-6q76S
<br />together with the note(s) and indebtedness, without recourse, described in and secured by
<br />the instrument aforesaid and all sums due or to become due thereunder. Nothing in this
<br />Assignment shall in any way impair or be construed as a transfer or conveyance of any
<br />rights or interest of the Trustee under the above - described Deed of Trust.
<br />TO HAVE AND TO HOLD the same unto the said Assignee and unto its successors
<br />and assigns forever.
