<br />TRUSTEE'S DEED
<br />This instrument, made this /Oday of September, 2004, between Eric H. Lindquist, a member of
<br />the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ", pursuant to a power of
<br />sale contained in that certain Deed of Trust recorded on July 19, 2002 as Instrument No. 0200207536 of the
<br />Mortgage Records in the office of the Register of Deeds of Hall County, Nebraska, and U.S. Bank National
<br />Association N.D., hereinafter called "Grantee ":
<br />WHEREAS, on June 2, 2004, Eric H. Lindquist, as Successor Trustee, executed a Notice of Default
<br />pursuant to which notice was given to Arlen Fritz and Kimberly Fritz, husband and wife, Trustors, under
<br />that certain Deed of Trust recorded on July 19, 2002 as Instrument No. 0200207536 of the Mortgage
<br />Records in the office of the Register of Deeds of Hall County, Nebraska, covering that certain premises des-
<br />cribed as:
<br />LOT 9, BLOCK 2, LAKE DAVIS ACRES SUBDIVISION, HALL COUNTY,
<br />NEBRASKA,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting forth the
<br />nature of such breach and of his election to sell or cause to be sold such property to satisfy the obligation.
<br />Said Notice of Default was filed for record in the Office of the Register of Deeds of Hall County, Nebraska,
<br />on June 7, 2004 as Instrument No. 0200405603 of the Miscellaneous Records of said County.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice pursuant to
<br />said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on July 28, 2004, Grantor caused to be published in the Grand Island
<br />Daily Independent, a newspaper having a general circulation in Hall County, Nebraska, a Notice of
<br />Trustee's Sale setting forth a description of the property to be sold and stating that the described property
<br />would be sold at public auction to the highest bidder for cash or certified or cashier's check, at the lower
<br />level lobby of the Hall County Courthouse, 1" & Locust Street, Grand Island, Hall County, Nebraska, at
<br />2:00 p.m. on September 7, 2004. Publication of such notice was made for five consecutive weeks on July
<br />28, 2004, August 4, 2004, August 11, 2004, August 18, 2004 and August 25, 2004, the last publication
<br />being at least ten (10) days but not more than thirty (30) days prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties entitled to
<br />notice pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Pursuant to said Notice of Trustee's Sale, John B. McDermott, attorney for Eric H. Lindquist,
<br />Successor Trustee, did at the time and place mentioned in said Notice of Trustee's Sale, offer said property
<br />for sale at public auction, and did sell the same to Grantee for the sum of $106,165.00, it being the highest
<br />bidder therefor.
<br />NOW, THEREFORE, in consideration of the premises and of the sum of $106,165.00 so bid and
<br />paid as aforesaid, I, Eric H. Lindquist, Successor Trustee, do hereby grant and convey unto said Grantee, its
<br />successors and assigns forever, all the estate, right, title and interest of which the said Arlen Fritz and
<br />Kimberly Fritz, husband and wife, and their successors in interest, were seized or possessed at the time said
<br />Deed of Trust was given, or at any time thereafter, in and to the premises sold as aforesaid, to -wit:
<br />LOT 9, BLOCK 2, LAKE DAVIS ACRES SUBDIVISION, HALL COUNTY,
<br />NEBRASKA.
