KNOW ALL MEN BY THESE PRESENTS:

<br />DECLARATION OF PURPOSE
<br />The purpose of this DECLARATION OF RESTRICTIVE COVENANTS,
<br />RESTRICTIONS AND CONDITIONS FOR TOWNHOUSE HOMEOWNERS ASSOCIATION
<br />OF AMICK ACRES WEST, is to declare the desire of Declarant to improve Lots One (1) and
<br />Two (2), all in Amick Acres West Fourth Subdivision, Hall County, Nebraska, by encouraging
<br />the sale of lots and the construction of townhouses as single family residences.
<br />In furtherance of this purpose, Declarant hereby declares that the lots of the property
<br />described above, shall be held, sold and conveyed subject to the following reservations,
<br />easements, limitations, restrictions, servitudes, covenants, conditions, charges and liens,
<br />(hereinafter collectively termed "covenants and conditions "), which are for the purpose of
<br />protecting the value and desirability of the lots herein described comprising TOWNHOUSE
<br />HOMEOWNERS ASSOCIATION OF AMICK ACRES WEST, and which shall run with the
<br />real property and be binding upon all parties having any right, title or interest in one of the
<br />described townhouse lots, or any part, their heirs, successors and assigns, and which shall inure
<br />to the benefit of each owner thereof.
<br />II.
<br />DESCRIPTION OF LAND
<br />The lands of the Declarant which are hereby submitted to this DECLARATION OF
<br />RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS FOR TOWNHOUSE
<br />HOMEOWNERS ASSOCIATION OF AMICK ACRES WEST are a fee simple interest in Lots
<br />One (1) and Two (2), all in Amick Acres West Fourth Subdivision, Hall County, Nebraska, all as
<br />surveyed and platted and is more particularly described as recorded in the office of the Register
<br />of Deeds of Hall County, Nebraska.
