<br />COUNTY OF HALL 200408394 AFFIDAVIT
<br />I, Thomas Bruggeman, being duly sworn, upon oath deposes and says as follows to wit:
<br />1. On this Date, he is a Registered Licensed Land Surveyor in the State of Nebraska.
<br />2. Affiant further states that on January 30, 1998 he completed a survey of a
<br />Permanent Utility Easement located in the Northwest Quarter of Section 34,
<br />Township 11 North, Range 9 West of the 6" P.M., Hall County, Nebraska, a
<br />easement recorded as Instrument Number 98- 103002 at the Register of Deeds
<br />Office located in the Hall County Administration Building.
<br />3. Affiant further stales that he has this date re- examined said Permanent Utility
<br />Easement located in Hall County, Nebraska, and has discovered an error on the
<br />second (2") line of said easement description.
<br />4. Affiant further states that said second (2"') line shall now road "NORTHWEST
<br />QUARTER OF SAID SECTION 34, TOWNSHIP I 1 NORTH, RANGE 9 WEST
<br />OF ", in lieu of "NORTHWEST QUARTER OF SAID SECTION 34,
<br />TOWNSHIP 11 NORTH, RANGE 9 EAST OF ", as now shown on the easement
<br />description, this second (2 "d) line being erroneous, null and void.
<br />5. Affiant further states that he has this date re- examined said Permanent Utility
<br />Easement located in Hall County, Nebraska, and has discovered an error on the
<br />seventh (70) line of said easement description.
<br />6. Affiant further states that said seventh (7r") line shall now read "DEFELCTING
<br />90 DEGRESS 00 MINUTES 00 SECONDS RIGIIT A DISTANCE OF 18.288 ",
<br />in lieu of "DEFLECTING 90 DEGRESS 00 MINUTES 00 SECONDS LEFT A
<br />DISTANCE OF 18.288 ", as now shown on the easement description, this seventh
<br />(7`h) line being erroneous, null and void.
<br />7. Afflant further states that he has this date re- examined said Permanent Utility
<br />Easement located in Hall county, Nebraska, and has discovered an error on the
<br />seventeenth (17 "') line of said easement description.
<br />8. Affiant further states that said seventeenth (17") line shall now read "32
<br />MINUTES 13 SECONDS RIGHT A DISTANCE OF 25.350 METERS (83.17
<br />FEET) TO A ", in lieu of "32 MINUTES 13 SECONDS LEFT A DISTANCE OF
<br />25.3 ERS (8117 FEET) TO A ", as now shown on the easement
