<br />TRUSTEE'S DEED
<br />KNOW ALL MEN BY THESE PRESENTS: That Ronald S. Depue, a
<br />member of the Nebraska State Bar Association and Trustee, upon a
<br />Deed of Trust made and entered into on or about December 10, 2002,
<br />by and between Bran Krishna Saba, a single person, Trustor, and
<br />Robert V. Clark and Bonnie Clark, husband and wife, Beneficiary,
<br />and Ronald S. Depue, Trustee, which Deed of Trust was filed on
<br />December 12, 2002, in the Register of Deeds office of Hall County,
<br />Nebraska, as Document No. 200213841, herein called the Grantor, in
<br />consideration of Forty -Three Thousand One Hundred Thirty -four and
<br />()B/100 Dollars ($43,134.08), received from Grantee, does hereby
<br />grant, bargain, sell, convey and confirm unto Thomas A. Emerton,
<br />herein called the Grantee, the following described real property in
<br />Hall County, Nebraska:
<br />Lot Eight (8), Block Sixteen (16), Baker's Addition, and
<br />its complement, to -wit: Fractional Lot Eight (8) in
<br />Fractional Block One (1) in Woodbine Addition, both
<br />additions to the City of Grand Island, Hall County,
<br />Nebraska.
<br />TO HAVE AND TO HOLD the above described premises together with
<br />all tenements, hereditaments, and appurtenances thereto belonging
<br />and to the Grantee.
<br />Grantor does hereby covenant with Grantee as follows:
<br />1. That Pran Krishna Saba, Trustor, failed to pay the
<br />Beneficiary payments which were contractually due and the Grantor,
<br />at the request of the Beneficiary, elected to declare the entire
<br />unpaid principal balance together with interest thereon at once
<br />immediately due and payable;
<br />2. That a notice of default was filed by Grantor on May 18,
<br />2004, in the Register of Deeds office of Hall County, Nebraska, as
<br />Document No. 200404956. A copy Of the notice of default was served
<br />upon Pran Krishna Saha, Trustor, by certified mail, postage prepaid
<br />on May 20, 2004;
<br />3. The Trustor, Bran Krishna Saha, failed to cure the
<br />default referenced in the notice of default within thirty days
<br />after the service of the notice of default;
