<br />1. Real Estate Taxes for calendar year 2004, which are payable in calendar year 2005.
<br />2. Mechanics, contractors or material men's liens and lien claims, if any, which arise by,
<br />through or as a direct result of Grantee, Wal -Mart Stores, Inc. and/or Wal -Mart Real
<br />Estate Business Trust.
<br />3. Items 1, 7, 10, 11, 12 and 13 as described in the General Notes of the ALTA/ACSM
<br />Survey dated June 11, 2004, as prepared by Daniel A. Thomson (Surveyor's License No.

<br />4. Easement for electric lines executed by Anne Last Christensen and Thomas E.
<br />Christensen, his wife, to Consumer's Public Power District, dated March 4, 1961, and
<br />filed with the Register of Deeds of Hall County, Nebraska on March 9, 1961 in Book 9,
<br />at Page 17.
<br />5. Permanent Easement for utilities and subsequent maintenance of such utilities as shown
<br />in Trustee's Easement filed April 1, 1998 in the office of the Register of Deeds of Hall

<br />6. Resolution No. 2001 -245, regarding a connection fee for water main, filed September 13,
<br />2001 in the office of the Register of Deeds of Hall County, Nebraska, as Instrument No.

<br />Nebraska recorded with the Register of Deeds of Hall County, Nebraska on April 1,
<br />1998, as Document No. 98- 103002.
<br />8. Ordinance No. 8888 regarding the annexation of the Real Estate, as adopted by the
<br />Mayor and the City Council of Grand Island, Nebraska on June 22, 2004, and
<br />subsequently recorded with the Register of Deeds of Hall County, Nebraska.
<br />9. Ordinance No. 8916 regarding the rezoning of the Real Estate, as adopted by the Mayor
<br />and City Council of Grand Island, Nebraska on June 22, 2004.
<br />10. Resolution No. 2004 -150 regarding the plat of the Real Estate, as adopted by the City
