<br />This instrument, made thisQ�dday of May, 2004, between Eric H. Lindquist, a member of
<br />�
<br />the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor", pursuant to a
<br />power of sale contained in that certain Deed of Trust recorded on November 2, 2001 as Instrument
<br />No. 0200111188 of the Mortgage Records in the office of the Register of Deeds of Hall County,
<br />Nebraska, and the Secretary of the Department of Housing and Urban Development, hereinafter
<br />called "Grantee ":
<br />WHEREAS, on March 12, 2004, Eric H. Lindquist, as Successor Trustee, executed a Notice
<br />of Default pursuant to which notice was given to Rogelio B. Alvarado, a single person, Trustor,
<br />under that certain Deed of Trust recorded on November 2, 2001 as Instrument No. 0200111188 of
<br />the Mortgage Records in the office of the Register of Deeds of Hall County, Nebraska, covering
<br />that certain premises described as:
<br />THE WEST 39 FEET OF LOT 3, BLOCK 136, UNION PACIFIC RAILWAY
<br />COMPANY'S SECOND ADDITION, AND ITS COMPLEMENT FRACTIONAL
<br />LOT 3 IN BLOCK 7, RUSSELL WHEELER ADDITION, GRAND ISLAND,
<br />HALL COUNTY, NEBRASKA,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on March 15, 2004 as Instrument No. 0200402449 of the Miscellaneous
<br />Records of said County.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on April 19, 2004, Grantor caused to be published in the
<br />Grand Island Daily Independent, a newspaper having a general circulation in Hall County,
<br />Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and stating
<br />that the described property would be sold at public auction to the highest bidder for cash or certified
<br />or cashier's check, at the lower level lobby of the Hall County Courthouse, 1St & Locust Street,
<br />Grand Island, Hall County, Nebraska, at 2:00 p.m. on May 27, 2004. Publication of such notice
<br />was made for five consecutive weeks on April 19, 2004, April 26, 2004, May 3, 2004, May 10,
<br />2004 and May 17, 2004, the last publication being at least ten (10) days but not more than thirty
<br />(30) days prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76 -1008
<br />R.R.S. Nebraska.
<br />Pursuant to said Notice of Trustee's Sale, John McDermott, attorney for Eric H. Lindquist,
<br />Successor Trustee, did at the time and place mentioned in said Notice of Trustee's Sale, offer said
<br />property for sale at public auction, and did sell the same to MidFirst Bank for the sum of
<br />$52,357.47, it being the highest bidder therefor. MidFirst Bank has assigned all of its right, title,
<br />and interest in and to such bid to Grantee.
