<br />This instrument, made this 7 day of July, 2004, between Eric H. Lindquist, a member of
<br />the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ", pursuant to a
<br />power of sale contained in that certain Deed of Trust recorded on December 20, 1999 as Instrument
<br />No. 99- 111972 of the Mortgage Records in the office of the Register of Deeds of Hall County,
<br />Nebraska, and SFJV- 2003 -1, LLC, hereinafter called "Grantee ":
<br />WHEREAS, on December 31, 2003, Eric H. Lindquist, as Successor Trustee, executed a
<br />Notice of Default pursuant to which notice was given to Mandee A. Carruth, a single person and
<br />Ryon M. Waage, a single person, Trustors, under that certain Deed of Trust recorded on December
<br />20, 1999 as Instrument No. 99- 111972 of the Mortgage Records in the office of the Register of
<br />Deeds of Hall County, Nebraska, covering that certain premises described as:
<br />FRACTIONAL LOT TEN (10) IN FRACTIONAL BLOCK TWENTY (20) IN
<br />WALLICH'S ADDITION AND IT'S COMPLEMENT, TO -WIT: FRACTIONAL
<br />LOT TEN (10), IN FRACTIONAL BLOCK FOUR (4), IN BONNIE BRAE
<br />ADDITION, BOTH BEING ADDITIONS TO THE CITY OF GRAND ISLAND,
<br />HALL COUNTY, NEBRASKA,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on January 14, 2004 as Instrument No. 2004 -00407 of the Miscellaneous
<br />Records of said County.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on February 26, 2004, Grantor caused to be published in the
<br />Grand Island Daily Independent, a newspaper having a general circulation in Hall County,
<br />Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and stating
<br />that the described property would be sold at public auction to the highest bidder for cash or certified
<br />or cashier's check, at the lower level lobby of the Hall County Courthouse, 1st & Locust Street,
<br />Grand Island, Hall County, Nebraska, at 10:00 a.m. on April 7, 2004. Publication of such notice
<br />was made for five consecutive weeks on February 26, 2004, March 4, 2004, March 11, 2004,
<br />March 18, 2004 and March 25, 2004, the last publication being at least ten (10) days but not more
<br />than thirty (30) days prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76 -1008
<br />R.R.S. Nebraska.
<br />Pursuant to said Notice of Trustee's Sale, Arend R. Baack, attorney for Eric H. Lindquist,
<br />Successor Trustee, did at the time and place mentioned in said Notice of Trustee's Sale, offer said
<br />property for sale at public auction, and did sell the same to Wells Fargo Bank, N.A., successor by
<br />merger to Wells Fargo Home Mortgage, Inc. for the sum of $59,883.25, it being the highest bidder
