BOLLES and <br />STEPHANIE A. BOLLES, husband and wife, Trustors, and THE OVERLAND NATIONAL <br />BANK OF GRAND ISLAND, n /k/a WELLS FARGO BANK, N.A., Beneficiary and AREND R. <br />BAACK, as Trustee. Said Deed of Trust was recorded in the office of the Register of Deeds of Hall, <br />Nebraska on December 19, 1997 as Document No. 97- 110746 of the Mortgage Records of Hall <br />County, Nebraska. WELLS FARGO BANK, N.A., f /k/a WELLS FARGO BANK NEBRASKA, <br />N.A., was named successor Trustee, replacing Arend R. Baack, by virtue of a Substitution of Trustee <br />dated February 10, 2004 and recorded February 19, 2004 as Instrument No. 0200401495 by the <br />Office of the Register of Deeds for Hall County, Nebraska. WELLS FARGO BANK, N.A., <br />Grantor, in consideration of the sum of Twenty -one Thousand and 00 /100 Dollars ($21,000.00) and <br />other good and valuable consideration received from WELLS FARGO BANK, N.A., does hereby <br />grant, bargain, sell, convey and confirm unto WELLS FARGO BANK, N.A., (hereinafter "Grantee" <br />where appropriate), the following- described real property in Hall County, Nebraska, to wit: <br />All of Lot 22 and the West 26.5 feet of Lot 23, all in Block 3, Blain Addition, <br />an Addition to the City of Grand Island, Hall County, Nebraska. <br />to have and to hold the above - described premises together with all tenements, hereditaments and <br />appurtenances thereunto belonging unto the Grantee and to Grantee's successors and assigns forever. <br />Grantor does hereby covenant with Grantee and Grantee's successors and assigns: <br />That Martin R. Bolles and Stephanie A. Bolles, husband and wife, as Trustors, failed to pay <br />to Beneficiary payments which were contractually due, and the Grantor, at the request of the <br />Beneficiary, elected to declare the entire unpaid principal balance, together with interest <br />thereon at once immediately due and payable. <br />2. That a Notice of Default as required by § 76 -1006 was filed by Grantor on February 20, <br />2004, as Instrument No. 0200401517 of the Miscellaneous Records in the office of the <br />Register of Deeds of Hall County, Nebraska. A copy of said Notice of Default was thereafter <br />mailed to all parties entitled to notice, pursuant to said Deed of Trust and in compliance with <br />§ 76 -1008, R.R.S. Nebraska. <br />3. That the Trustor failed to cure the default referenced in the Notice of Default within 30 days <br />after filing of the Notice of Default. <br />4. That an Amended Notice of Trustee's Sale was filed by Grantor on May 14, 2004 as <br />Instrument No. 0200404809 of the Miscellaneous Records in the office of the Register of <br />Deeds of Hall County, Nebraska. A copy of said Notice of the time and place of the sale was <br />thereafter mailed to all parties entitled to notice pursuant to said Deed of Trust and in <br />compliance with § 76 -1008, R.R.S. Nebraska. <br />5. That Grantor as required by § 76 -1007 published Notice of Trustee's Sale to be held on June <br />28, 2004 at 10:00 a.m., in the lower lobby of the Hall County Courthouse, 111 West First <br />Street, Grand Island, Nebraska. Said Notice was published in Grand Island Independent, a <br />legal newspaper of Grand Island, Hall County, Nebraska, once a week for five consecutive <br />weeks commencing on May 14, 2004 and ending on June 11, 2004.
