AFFIDAVIT OF IDENTITY

<br />In Re: The East Forty -Four Feet (E44') of the North Ninety -Eight
<br />Feet (N981) of Lot Three (3) in Block Three (3) in
<br />Lakeview Addition to the City of Grand Island, Hall
<br />County, Nebraska.
<br />B. J. Cunningham, being first duly sworn on oath, deposes and
<br />states as follows:
<br />1. That Affiant has practiced law in Grand Island, Hall
<br />County, Nebraska, since 1951, and was well and personally
<br />acquainted with Terrence David Lachnit, sometimes known as Terry D.
<br />Lachnit, and with his spouse, Dolores E. Lachnit, for more than 40
<br />years last past.
<br />2. That Terry D. Lachnit, one of the Grantees with his
<br />spouse, Dolores E. Lachnit, in a Survivorship Warranty Deed
<br />recorded in the Office of the Register of Deeds of Hall County,
<br />Nebraska, on December 16, 1963, in Book 143 of Deeds at Page 574,
<br />and Terrence David Lachnit, whose estate is being probated in the
<br />County Court of Hall County, Nebraska, Estate No. PR04 -46, and
<br />being the named Decedent in a Deed of Distribution recorded in the
<br />Office of the Register of Deeds of Hall County, Nebraska, on July
<br />2, 2004, as Document No. 200406568, was one and the same person
<br />despite the discrepancy in names.
<br />3. That Affiant knows of his own knowledge that the said
<br />Dolores E. Lachnit died June 18, 2002, at Grand Island, Hall
<br />County, Nebraska, and that a copy of her Certificate of Death
<br />issued by the Nebraska Department of Health and Human Services is
<br />hereto attached, marked Exhibit "A" and made a part hereof, and
<br />that said Exhibit "A" is a true and exact copy of the original
<br />Certificate of Death issued by the State.of Nebraska.
<br />Further Affiant sayeth not.
