<br />and 00 /100ths Dollars ($100.00) and other good and valuable consideration received from
<br />GRANTEE, Wal -Mart Real Estate Business Trust, a Delaware Statutory Trust, conveys to
<br />GRANTEE, the following described real estate (as defined in Nebraska Revised Statutes Section
<br />76 -201):
<br />Lot 1, Block 1 of Wal -Mart South A44#0M to the City of Grand Island,
<br />Hall County, Nebraska; and Outlots A, C and D of Wal -Mart South
<br />man to the City of Grand Island, Hall County, Nebraska
<br />subject only to those specific easements, covenants and restrictions more particularly identified
<br />on Exhibit "A" which is attached hereto and incorporated herein by this reference as if fully set
<br />forth (the "Permitted Exceptions ").
<br />GRANTOR covenants with GRANTEE that GRANTOR:
<br />(1) is lawfully seized of the real estate described above, and that such real estate is free from
<br />encumbrances, except as described on Exhibit "A" hereto;
<br />(2) has legal power and authority to convey the same; and
<br />(3) warrants and will defend title to the real estate against any acts of the GRANTOR.
