GALLES is the <br />successor Trustee under a Deed of Trust made and entered into on or about February 23, 2001 by and <br />between KATHRYN A. THORNBRUGH, a single person, Trustor, and MICHAEL F. KIVETT, <br />Trustee, and POPULAR FINANCIAL SERVICES, L.L.C., Beneficiary. Said Deed of Trust was <br />recorded in the office of the Register of Deeds of Hall County, Nebraska, on February 27, 2001 as ' SU <br />Document No. 200101445 of the Mortgage Records of Hall County, Nebraska. GREGORY L. <br />GALLES, has been appointed as Trustee, replacing Michael F. Kivett, by virtue of a Substitution of <br />Trustee dated March 25, 2004 and recorded April 5, 2004 as Instrument No. 0200403266 of the <br />Miscellaneous Records of Hall County, Nebraska. GREGORY L. GALLES, Grantor, in <br />consideration of the sum of Thirty -five Thousand Two Hundred Seventy -four and 82/100 Dollars <br />($35,274.82) and other good and valuable consideration received from POPULAR FINANCIAL <br />SERVICES, L.L.C. does hereby grant, bargain, sell, convey and confirm unto POPULAR <br />FINANCIAL SERVICES, L.L.C., (hereinafter "Grantee" where appropriate), the following - <br />described real property in Hall County, Nebraska, to wit: <br />Lot 3, Fractional Block 148, Union Pacific Railway Company's Second <br />Addition to the City of Grand Island, Hall County, Nebraska. <br />to have and to hold the above - described premises together with all tenements, hereditaments and <br />appurtenances thereunto belonging unto the Grantee and to Grantee's successors and assigns forever. <br />Grantor does hereby covenant with Grantee and Grantee's successors and assigns: <br />That Kathryn A. Thornbrugh, a single person, as Trustor, failed to pay to Beneficiary <br />payments which were contractually due, and the Grantor, at the request of the Beneficiary, <br />elected to declare the entire unpaid principal balance, together with interest thereon at once <br />immediately due and payable. <br />2. That a Notice of Default as required by § 76 -1006 was filed by Grantor on April 5, 2004 as <br />Instrument No. 0200403267 of the Miscellaneous Records in the office of the Register of <br />Deeds of Hall County, Nebraska. A copy of said Notice of Default was thereafter mailed to <br />all parties entitled to notice, pursuant to said Deed of Trust and in compliance with § 76- <br />1008, R.R.S. Nebraska. <br />3. That the Trustor failed to cure the default referenced in the Notice of Default within 30 days <br />after filing of the Notice of Default. <br />4. That a Notice of Trustee's Sale was filed by Grantor on May 19, 2004, as Instrument No. <br />(120040 -+990 of thc'.1l iscellaneoas Records in the office of the Register of Deeds of Hall <br />County, Nebraska. A copy of said Notice of the time and place of the sale was thereafter <br />mailed to all parties entitled to notice pursuant to said Deed of Trust and in compliance with <br />§ 76 -1008, R.R.S. Nebraska. <br />5. That Grantor as required by § 76 -1007 published Notice of Trustee's Sale to be held on June <br />28, 2004, at 10:00 a.m., in the lobby of the Hall County Courthouse, 11 I West First Street, <br />Grand Island, Nebraska. Said Notice was published in the Grand Island Independent a legal <br />newspaper of Hall County, Nebraska, once a week for five consecutive weeks commencing <br />on May 19, 2004 through June 16, 2004. The last publication notice was at least ten days <br />prior to the Trustee's Sale held on June 28, 2004, and said sale was not later than 30 days <br />after the last publication of notice. <br />1 <br />
