240405934 (d) Trade Contractor's right to recover damages arising out of force majeure events or acts or omissions of the Owner and/or persons or entities for whom the Owner is responsible is limited to the same extent that SIGNATURE's right to recover such damages is limited by the Contract Documents; and (e) The terms and provisions of this Trade Contract relating to Trade Contractor's Work are in addition to and not in substitution of any of the terms and conditions of the Contract Documents. 3.5 Familiarity With Jobsite Conditions: Trade Contractor represents that it has: (a) made an on -site inspection of the Job Site; (b) investigated and satisfied itself with respect to: (1) the locality where Trade Contractor's Work is to be performed and the conditions and difficulties to be encountered, including access thereto; (2) the quality and quantity of subsurface and surface materials or obstacles to be encountered insofar as this information is reasonably ascertainable from the Contract Documents, inspection of the Project Site or the results of any tests conducted by Owner or its representatives which are included in the Contract Documents; (3) the availability of utilities and access thereto; (4) the equipment and facilities needed preliminary to and during performance of the Work; (5) the conditions affecting transportation, disposal, handling and storage of materials, supplies and equipment; (6) the availability and adequacy of personnel and workers and the prevailing wage scales and, if applicable, union scales, benefits and working conditions, craft jurisdictions, craft area practices and existing collective bargaining agreements including any signed by or on behalf of SIGNATURE; (7) prevailing weather and climatological conditions as well as uncertainties of weather, river stages, tides or similar physical conditions at the Job Site; (8) all laws applicable to the Work or Trade Contractor; (9) any other factors which may affect Trade Contractor's Work; and (c) correlated its observations with the requirements of this Trade Contract and the Contract Documents. 3.6 ' Reliance by Trade Contractor on Own Investigation: Trade Contractor has executed this Trade Contract solely in reliance on its own examination, investigation and evaluation of the matters herein and has not relied upon any representations of SIGNATURE, the Owner, the Architect or any of their respective agents or employees except to the extent such representations are expressly stated in this Trade Contract or the Contract Documents. 3.7 No Claims for Failure to Comply: Neither SIGNATURE nor the Owner shall be liable to Trade Contractor for any claim for an adjustment to the Trade Contract Price or an extension of time which directly or indirectly arises from Trade Contractor's failure to investigate or familiarize itself with the Contract Documents or the conditions under which this Trade Contract is to be performed. 3.8 Design Deficiencies: Trade Contractor shall give SIGNATURE prompt written notice of any condition or omission in the Contract Documents which Trade Contractor believes is or may be a design error or deficiency or not in compliance with applicable building codes and other regulations governing work.
