<br /> ak <br /> mown" <br /> <br /> <br /> <br /> <br /> <br /> <br /> . 93-JUG,37 <br /> <br /> <br /> <br /> S AGREEMENT made and executed this ~ day of <br /> , 1993, by and between the VILLAGE OF AI,DA, NEBRASKA, <br /> ereferred to as "Municipality", and A-G PIPE & <br /> TRENCHING, ; . partnership, hereinafter referred to as <br /> "Subdivider". <br /> WITNESSETH: <br /> WHEREAS, Subdivider has heretofore requested approval of <br /> and Municipality has heretofore approved, a subdivision identi- <br /> fied as A-G ACRES SECOND SUBDIVISION, an addition to the Village <br /> of Alda, Ball County, Nebraska; <br /> WHEREAS, Subdivider has now requested that a portion of such <br /> subdivision and plat be vacated; <br /> WHEREAS, Municipality has, by resolution adopted in its reg- <br /> ular meeting of October 5, 1993, agreed to vacate the requested <br /> portion of such plat and subdivision, subject to the retention by <br /> Municipality of all easements therein contained; <br /> WHEREAS, Subdivider agrees that all such easements specified <br /> by the plat hereby to be vacated in part shall be, and remain; <br /> permanent easements upon the real estate for the benefit of <br /> Municipality; <br /> NOW, THEREFORE, in consideration of the mutual agreements <br /> herein contained, it is agreed: <br /> 1. Confirmation of Easements. Subdivider hereby <br /> conveys and confirms unto Municipality, successors grants, r <br /> assigns, easements for the location, constructionandmaand <br /> intenance 1 <br /> of public service utilities forever, together with the right of <br /> ingress and egress thereto, as heretofore identified upon the <br /> recorded plat of A-G Acres Second Subdivision, filed as Document <br /> No. 92-106258 in the office of the Register of Deeds of Hall <br /> County, Nebraska, hereby intending such easements to be identi- <br /> fied, in particular, as: <br /> Commencing at the southwest corner of Lot One (1) A-G <br /> Acres Subdivision, Hall County, Nebraska; t' -uce run- <br /> ning northerly along and upon the west line o' said Lot <br /> (1), a distance of Ten (10) Feet; thence running east- <br /> erly parallel to the south line of said Lot one (1), a <br /> distance of one Hundred Forty-one and Forty-Eight Hun- <br /> dredths (141.48) Feet; thence running northerly paral- <br /> lel to the west line of said Lot (1) to a point located <br /> upon the north line of said Lot (1), a distance of <br /> Three Hundred Ten (310) Feet; thence running easterly <br /> along the north line of said Lot (1), a distance of <br /> Sixteen (16) Feet; thence running southerly parallel to <br /> 1 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> i <br />
