<br />THIS AGREEMENT, made as of the 30th day of April, 2004, by MARK A. PURDIE AND
<br />JODY L. PURDIE, HUSBAND AND WIFE AS JOINT TENANTS, an owner or owners of
<br />the land hereinafter described and hereinafter referred to as "Owner," and AMAXIMIS
<br />LENDING, LIMITED PARTNERSHIP, a Delaware limited partnership, ( "Amaximis ")
<br />present beneficiary of record and servicing agent, and OLD KENT BANK, a Michigan
<br />corporation, ( "Old Kent ") present equity owner and holder of the deed of trust and note
<br />hereinafter described, Amaximis and Old Kent hereinafter referred to individually and
<br />collectively as "Beneficiary",
<br />WITNESSETH
<br />THAT WHEREAS, Owner did execute a Deed of Trust dated May 19th, 1998 to
<br />AMERICAN TITLE COMPANY, covering:
<br />SEE EXHIBIT "A" ATTACHED HERETO AND INCORPORATED HEREIN FOR ALL
<br />PURPOSES
<br />which has a street address of 4231 NEVADA AVENUE
<br />GRAND ISLAND, NE 68803
<br />to secure a note in the sum of $45,000.00, dated May 19th, 1998, in favor of FIRST
<br />SUBURBAN CORPORATION MTG BANKERS, which Deed of Trust was recorded as
<br />Reception No. 98- 106081, on JUNE 24, 1998, in the Official Records of HALL County
<br />State of Nebraska; assigned to AMAXIMIS LENDING LIMITED PARTNERSHIP,
<br />assignment was recorded on JULY 23, 1998 as Instrument No. 98- 107163, Book,
<br />Page in the Official Records of HALL, county, state of Nebraska; and
<br />WHEREAS, "Owner" has executed, or is about to execute, a security instrument (Deed of
<br />Trust or Mortgage), hereinafter "Security Instrument," and note in the sum not to exceed
<br />$101,899.00 in favor of AMERICA'S CHOICE MORTGAGE INC., ISAOA hereinafter
<br />referred to as "Lender ", payable with interest upon the terms and conditions described
