<br /> <br />193-110905 <br /> <br /> <br />PARTIAL RELEJ\.SB FROM DECLARATION OF TRUST <br /> <br />Wher:'!8s, the Hall County Housing Authority, herein called the "Public <br />Housing Autho:dty (PHA) " a public body corporate and politic, created and <br />organized pursuant to the laws of the State of Nebraska and the U.S. Department <br />of Housing and Urban Development (HUD) pursuant to the United States Housing Act <br />of 1.937 (42 IT. S . C . 14 3 7, et seq.) and the Department ot Housing and Urban <br />Development Act (5 U.S.C. 624) entered into a certain contract with the effeet~ve <br />date of .April 30, 1962, herein called the .Annual Cattributicns Contract, Contract <br />Number C-352. <br /> <br />Whereas, to assure HTJD of the performance ):)y the PHA of the covenants <br />contained in the Annual Contributions Contract, the PHA possessing and hOlding <br />in trust for the benefit of HOD executed a Declaration of Trust dated February <br />15, 1989, recorded on February 16, 1989, as Document Number 89-100765, with the <br />Register of DeedR of Hall County with respect to the following descrihed real <br />property including all buildings and fixtures erected or to be erected thereon <br />or appur~enant thereto: <br /> <br />Lot Fifteen (15j, Bishop Heights Subdivision, Hall County, <br />Nebraska. <br /> <br />a/k/a 4337 Sherwood Drive <br /> <br />Whereas, the PHA intends to enter into and perform contracts for the sale <br />of dwelling units to members of tenant families, as authorized by the United <br />States Housing Act of 1937. <br /> <br />Now by execution of this Release by the duly authorized officer of HOD <br />subscribed below to allow the transfer of the property described above, HOD does <br />hereby release said property from the trust created by the Declaration of Trust <br />referenced above. <br /> <br />U.S. Department of Housing and Urban Developmp.nt <br /> <br />By: <br /> <br /> <br />Dated: <br /> <br />NUV 3 0 1993 <br />
