<br />'" <br /> <br />.. <br /> <br /><~:..l. <br /> <br />SECTION 8. <br /> <br />Maintenance and Repair. <br /> <br />'93~10869 <br />The Company shall <br /> <br />keep the Pro~ect in good condition and repair making from time to <br /> <br />time all necessary repairs thereto and renewals and replacements <br /> <br />thereof, and covenants not to commit or permit waste thereof, and <br /> <br />shall not remove or demolish nor alter or impair the design or <br /> <br />structural character of any building, fixture, equipment, or other <br /> <br />improvements now or hereafter situated upon the Project without the <br /> <br />prior written consent of the Trustee, and shall not do or permit <br /> <br />any other act or thing that will damage the Project or cause the <br /> <br />same to depreciate in value. <br /> <br />SECTION 9. Removal of Eauipment. The Company may remove <br /> <br />and dispose of items of Equipment from the site of the Project as <br /> <br />is provided in the Agreement. <br /> <br />SECTION 10. Release of Certain Land. The Issuer and the <br /> <br />Trustee reserve the right at any time and from time to time to (i) <br /> <br />release irom this Mortgage any unimproved part of the Land (on <br /> <br />which neither the Building nor any Equipment as defined in the <br /> <br />A.greement is sit'iated) on which the Company then proposes to <br /> <br />construct improvements which are not part of the proj ect; (ii) <br /> <br />release from this Mortgage any part of the Land with respect to <br /> <br />which the Company proposes to grant an easement or convey fee <br /> <br />title to a railroad, public utility, or public body in order that <br /> <br />railr-:Jad, utility services, or roads may be provided for the <br /> <br /> <br />Project, provided that in either case there shall be deposited with <br /> <br />the Trustee the following: <br /> <br />(a) a written release; <br /> <br />13 <br /> <br />
