20040562" <br />MONITORING WELL INSTALLATION <br />& ACCESS AGREEMENT <br />SITE ADDRESS: <br />202 West P Street Grand Island, NE 68801 <br />As owner of the above - referenced property, Downtown Center, LLC ( "Owner ") hereby grants <br />Wells Fargo Bank, N.A. ( "Wells Fargo ") and its contractor(s) the right to enter upon <br />referenced property for the sole purpose of installing two (2) groundwater monitoring well(s) <br />at the approximate location(s) identified on the attached diagram. Wells Fargo or its <br />contractor(s) shall consult and reach an agreement with the property owner prior to installing <br />such well(s) at alternate or additional location(s). <br />The monitoring well(s) will be installed in accordance with state well codes. Wells Fargo and <br />its contractor(s) shall take reasonable precautions to minimize damage to Owner's property <br />from the installation of the well(s) and shall restore your premises to as close to the original <br />condition as reasonably possible. Wells Fargo shall hold Owner harmless from and against <br />any and all claims, loss, damage, injury to person or property or liability of any kind <br />whatsoever arising directly or indirectly from all acts or omissions, negligent or otherwise, in <br />the installation and restoration activities contemplated hereunder by ourselves, our employees, <br />agents, contractor(s) and their employees and agents. The foregoing indemnification and hold, <br />harmless shall include but not be limited to claims arising out of leaks, spillage, or soil or <br />water contamination of any kind to the owner's above referenced property. <br />Wells Fargo and its contractor(s) shall have the right to enter upon the property identified <br />above at reasonable times and in a reasonable manner for the purpose of measuring water <br />levels or taking samples from the monitoring well(s), and for the purpose of servicing, <br />maintaining and removing the well(s). <br />The monitoring well(s) will be allowed to remain in place for as long as deemed necessary by <br />the Nebraska Department of Environmental Air Quality or other federal, state or local <br />authorities. When no longer needed, the monitoring well(s) will be immediately sealed and <br />abandoned in a timely manner and in accordance with Nebraska Department of Health <br />regulations. <br />
