<br />This License Agreement is made by and between the CITY OF GRAND ISLAND,
<br />NEBRASKA, a Municipal Corporation, herein referred to as the "City" and DOWNTOWN
<br />CENTER, L.L.C., a limited liability company, its successors and assigns, hereinafter refereed to
<br />as "DC."
<br />1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set
<br />forth the terms and conditions under which DC may construct, maintain, repair, and utilize the
<br />following described improvement which will infringe upon the public right -of -way:
<br />Installation of permanent ground level groundwater monitoring well to be placed
<br />in the city right -of -way on the east side of 202 West Third Street, legally
<br />described as .Lot Eight (8), [clock Fifty Six (56) in Grand Island, Hall County,
<br />Nebraska.
<br />2. DC'S DUTIES AND RISKS. It is understood and agreed that DC may construct,
<br />maintain, repair and utilize the above described improvement at the DC's sole risk provided,
<br />however, that the City will provide all available information, through Diggers Hotline or
<br />otherwise, regarding subsurface utilities, including, but not limited to sewers, electrical, gas and
<br />water. DC hereby waives any claim for damages against the City, its officers, employees, agents
<br />and independent contractors for any damage or injury that may result to said improvement. If
<br />the City, in its sole discretion, determines that any part or all of the improvement must be
<br />removed or is damaged by the City, its employees, agents or independent contractors working for
<br />the City during the course of their employment or duties with the City, DC agrees to assume and
<br />pay all costs relating to the replacement or repair of the improvement.
<br />It is understood that the exact location of the monitoring well will be determined in the
<br />field, however the preferred site for such monitoring well is in the sidewalk area.
