THIS EASEMENT SHALL BE MANAGED AND ADMINISTERED BY <br /> THE CITY OF GRAND ISLAND. <br /> B. THE CITY OF GRAND ISLAND MAY ENFORCE ALL THE TERMS <br /> AND CONDITIONS OF THIS EASEMENT, ALONG WITH ALL <br /> RIGHTS AND POWER RESERVED IN THIS EASEMENT, THROUGH <br /> SUCH GENERAL OR SPECIFIC REGULATIONS OR ORDERS AS <br /> HAVE BEEN, OR MAY FROM TIME TO TIME BE, PROMULGATED <br /> UNDER ITS GENERAL GOVERNMENTAL AUTHORITY. <br /> C. CONDEMNEE (S) SHALL PAY ALL REGULAR AND SPECIAL REAL <br /> ESTATE TAXES LEVIED UPON THE SUBJECT LAND. <br /> GENER.AL PROVISIONS <br /> A. THE AGREED UPON PURPOSE OF THIS EASEMENT IS THE <br /> PROTECTION OF THESE LANDS FROM COMMERCIAL AND <br /> INDUSTRIAL DEVELOPMENT, INCLUDING BUT NOT LIMITED <br /> TO ACCESS ROADS, COMMERCIAL OR INDUSTRIAL <br /> DEVELOPMENT ACROSS THE LAND, MINING OR EXTR.ACTION <br /> OF SAND, GR.AVEL OR OTHER MINERALS, AND THE USE OF <br /> LIGHTED SIGNS ANNUALLY DURING THE PERIOD OF <br /> FEBRUARY 1 THROUGH MAY 31 . THIS AGREEMENT IS NOT <br /> MEANT TO AFFECT THE INSTALLATION, OPERATION AND <br /> MAINTENANCE OF LIGHTED INFORMATIONAL, REGULATORY OR <br /> TR.AFFIC CONTROL SIGNS LOCATED WITHIN THE RIGHT-OF- <br /> WAY OF INTERSTATE 80 . ANY AMBIGUITIES IN THIS <br /> EASEMENT SHALL BE CONSTRUED IN A MANNER WHICH BEST <br /> EFFECTUATES PRESERVATION AND PROTECTION OF THE <br /> EXISTING CR.ANE AND OTHER WILDLIFE HABITAT. <br /> B. ANY SUBSEQUENT AMENDMENT OR REPEAL OF ANY FEDERAL <br /> OR STATE LAW, ORDER, OR REGULATION SHALL NOT AFFECT <br /> THE RIGHTS RESERVED BY THE CITY OF GRAND ISLAND, <br /> ITS SUCCESSORS AND ASSIGNS . <br /> C. THE CITY OF GR.AND ISLAND, ITS SUCCESSORS AND <br /> ASSIGNS, SHALL HAVE THE RIGHT TO MAKE STUDIES OR <br /> SURVEYS, TAKE PHOTOGR.APHS, PREPARE SUCH <br /> DOCUMENTATION, AND UNDERTAKE SUCH MONITORING IN THE <br /> FUTURE AS MAY BE NECESSARY OR DESIRABLE TO <br /> ADMINISTER THE PROVISIONS OF THIS EASEMENT. ANY <br /> SUCH MAP, PLAT, OR OTHER SUITABLE DOCUMENT MAY BE <br /> RECORDED IN THE LAND RECORDS OF THE RESPECTIVE <br /> COUNTY IN WHICH THE PROPERTY IS LOCATED. ANY ENTRY <br /> UPON INTERSTATE 80 RIGHT-OF-WAY MUST BE APPROVED BY <br /> THE NEBRASKA DEPARTMENT OF ROADS . <br /> D. THE EASEMENT RESERVATION ALONE DOES NOT AUTHORIZE <br /> PUBLIC ENTRY UPON OR USE OF THESE LANDS. <br /> E. CONDEMNEE(S) AND INVITEES MAY HUNT, FISH, AND TRAP <br /> ON THESE LANDS IN ACCORDANCE WITH APPLICABLE <br />
