<br /> in the office of the Register of Deeds of Ha11 County,Nebraska, and recorded on October 30, 1997,
<br /> as Document 97-109104 of the Mortgage Records of Ha11 County, Nebraska, and assigned to
<br /> CONTIMORTGAGE CORPORATION by Assignment dated November 4, 1997, and filed for
<br /> record on February 2, 1998, as Document No. 98-100380 of the Mortgage Records of Hall County,
<br /> Nebraska. DONALD J. PAVELKA, JR. has been appointed as Trustee, replacing Sandra M.
<br /> Kong by virtue of a Substitution of Trustee dated July 13, 1999, and filed for record on July 16,
<br /> 1999, as Document No. 99-107159 of the NTiscellaneous Records of Ha11 County,Nebraska. Donald
<br /> J. Pavelka, Jr., Grantor, in consideration of the sum of Fifty-Eight Thousand and 00/100 Dollars
<br /> ($58,000.00) and other good and valuable consideration received from CONTIlVIORTGAGE
<br /> CORPORATION, does hereby grant, bargain, sell, convey and confirm unto ContiMortgage
<br /> Corporation (hereinafter "Crrantee"where appropriate),the following-described real property in Hall
<br /> County, Nebraska, to wit:
<br /> Lot Seven(7)Except the Southerly five(5)feet thereof, and all of Lot
<br /> Five (5), in Block Three (3), in IJNIVERSITY PLACE, an Addition
<br /> to the City of Grand Island, Ha11 County, Nebraska,
<br /> to have and to hold the above-described premises together with all tenements, hereditaments and
<br /> appurtenances thereunto belonging unto the Grantee and to Grantee's successors and assigns forever.
<br /> Grantor does hereby covenant with Grantee and Grantee's successors and assigns:
<br /> 1. That Sondra R. Fry, as Trustor, failed to pay to Beneficiary payments which were
<br /> contractually due, and the Grantor, at the request of the Beneficiary, elected to declare the
<br /> entire unpaid principal balance, together with interest thereon at once immediately due and
<br /> payable.
<br /> 2. That Sondra R. Fry filed her Petition for Relief under Chapter 7 of the United States
<br /> Bankruptcy Code on June 11, 1999, and by Journal Entry of the Bankruptcy Court dated
<br /> August 27, 1999, relief from the Automatic Stay was granted to ContiMortgage Corp. A
<br /> copy of said Order is attached hereto marked as Exhibit "A".
<br /> 3. That a Notice of Default as required by § 76-1006 was flled by Crrantor on September 21,
<br /> 1999, as Document No. 99-109284 of the Miscellaneous Records in the office of the Register
<br /> of Deeds of Hall County, Nebraska. A copy of said Notice of Default was thereafter mailed
<br /> to all p ies entitled to notice, pursuant to said Deed of Trust and in compliance with § 76-
<br /> 1 QO&�R.S. Nebraska.
<br /> . 4. That the Trustor failed to cure the default referenced in the Notice of Default within 30 days
<br /> after filing of the Notice of Default.
<br /> 5. That a Notice of Trustee's Sa1e was filed by Grantor on October 22, 1999, as Document No.
<br /> 99-110264 of the Miscellaneous Records in the office of the Register of Deeds of Hall
<br /> County, Nebraska. A copy of said Notice of the time and place of the sale was thereafter
<br /> mailed to a11 parties entitled to notice pursuant to said Deed of Trust and in compliance with
<br /> § 76-1008, R.R.S. Nebraska.
