<br /> GAS UTILITY EASEMENT
<br /> KNOW ALL MEN BY THESE PRESENTS:
<br /> That SHARON L. JOHNSON .Grantor
<br /> of the County of Haii , the State of Nebraska for and in consideration
<br /> of the sum of one Dollar ($1.00) and other good and valuable consideration, the receipt af which is hereby
<br /> acknowledged, does hereby grant, remise, convey and relinquish unto Northwestern Public Service, a
<br /> Division of Northwestern Corporation, a Delaware Corporation, Grantee, Huron, South Dakota, its
<br /> successors or assigns, a utility easement, for the installation, maintenance and operation of a natural gas
<br /> pipeline, and appurtenances thereto, over, under, upon and through the following described lands situated in
<br /> the County of Hall , the State of Nebraska , to wit:
<br /> A Sixteen foot(16') wide strip of land over and across a portion of Lot Two (2) of
<br /> Meadowlark Estates Third Subdivision, a Part of the Southwest Quarter (SW1/4) of the
<br /> Northeast Quarter(NE1/4) of Section Thirty-two (S32), Township Eleven North (T.11 N.),
<br /> Range Nine West (R.9 W.) of the Sixth (6th) Principal Meridian, Hall County Nebraska,
<br /> with a centerline described as follows;
<br /> Commencing at the Southwest corner of Lot Two (2) of Meadowlark Estates Third
<br /> Subdivision, thence Northerly along the West property line of said Lot Two (2) a
<br /> distance of One Hundred Fifty feet(150')to the point of Beginning, thence in a
<br /> Northeasterly direction across said Lot Two (2) a distance of Two Hundred Ninety-
<br /> eight feet(298') more or less to the Point of Termination, said point being the
<br /> intersection of the East property line of said Lot Two (2)with the centerline of a
<br /> Sixteen foot(16')wide easement running East and West across Lot One (1) and
<br /> Lot Two (2) of Meadowlark Estates Third Subdivision, said point of termination
<br /> being Eighty-six feet(86') More or less Southerly from the Northeast property
<br /> corner of said Lot Two (2).
<br /> (The purpose of the above described easement is for a buried natural gas pipeline
<br /> along with all appurtenances thereto).
<br /> "Grantor warrants that neither she nor any member of her family claims the above
<br /> property as a homestead, Grantor now occupying and claiming other property as a
<br /> homestead."
<br /> TO HAVE AND TO HOLD unto said NORTHWESTERN PUBLIC SERVICE COMPANY, its successors
<br /> and assigns, so long as such natural gas pipeline and appurtenances thereto shall be maintained and
<br /> operated, together with the right of ingress and egress from said premises for the purpose of surveying,
<br /> constructing, installing, inspecting, repairing, maintaining, renewing and replacing the property of the Grantee
<br /> located thereon, or removed thereof, in whole or in part, at the will of the Grantee.
<br /> The Grantor further covenants for herself, her heirs, lessees, successors, or assigns, that the Grantee,
<br /> its lessees, successors or assigns shall at all times have the right to cut and remove or trim all trees, bushes
<br /> and saplings growing upon said lands above described, or extending over same, so far as may be reasonably
<br /> necessary for the construction, reconstruction, operation, repair, and maintenance of said natural gas pipeline,

<br /> Grantee agrees that should relocation of its natural gas pipeline become necessary it will be
<br /> relocated at Grantee's expense, provided that the Grantor grants a new easement before relocation of
<br /> any of the natural gas pipeline or appurtenances thereto.
<br /> The Grantee shall pay for all damages to landscaping, g�rdens, roads and driveways, fences,
<br /> livestock, crops and fields, subject to Grantor providing means of ingress and egress, caused by the
<br /> construction, reconstruction, repair, replacement, or maintenance of said natural gas pipeline.
<br /> The Grantor reserves the right to cultivate, use and occupy the above described lands, except that
<br /> Grantor shall not erect any structures or other objects, permanent or temporary, except fences, thereon.
<br /> Grantor further agrees that he will not perform any act which will interfere with or endanger said natural gas
<br /> pipelines, that he will not plant any trees upon the above described lands without the prior expressed written
<br /> approval from the Grantee. N�PS
