David C. Powers and Rosemary Powers, husband and wife, ASSIGNORS, do hereby
<br />assign to UNION BANK & TRUST COMPANY, ASSIGNEE, as additional security for 'Sa
<br />payment of a loan made to Assignor by Assignee in the amount of SEVENTY -FIVE
<br />THOUSAND DOLLARS ($75,000.00) the Lease dated July 27, 2001, wherein Kuester Lake,
<br />Inc. is the Lessor and Assignor is the Lessee, pertaining to the following - described premises:
<br />Lot Twenty -One (21) situated on the West side of the West Portion of Kuester
<br />Lake and being on a part of the East Half of the Southwest Quarter (E '/2 SW
<br />1/4) of Section Thirteen (13), Township Eleven (11) North, Range Nine (9)
<br />West of the 6th P.M., Hall County, Nebraska.
<br />It is understood that if the Assignors pay said indebtedness of Forty -nine Thousand
<br />Dollars ($49,000.00) plus interest and according to the provisions of the Financing Statement
<br />given by them to the Assignee, that this Conditional Assignment of said Lease will thereafter
<br />be null and void and of no furth r force nor effect.
