<br />TRUSTEE'S DEED
<br />Martin P. Pelster, Successor Trustee, does hereby grant and convey, without any //-60
<br />covenant or warranty, express or implied, to First National Acceptance Company, a
<br />Michigan corporation, its successor and assigns (hereinafter called Grantee), the following
<br />described property:
<br />The Westerly thirty -three (33) feet of Fractional Lot Six (6), in Fractional
<br />Block One Hundred Forty -three (143) of Union Pacific Railway Company's
<br />Second Addition, and all that part of Fractional Lot Seven (7), in Fractional
<br />Block Eleven (11), of Russel Wheeler's Addition, lying West of the Easterly
<br />thirty -three (33) feet of said Fractional Lot Seven (7), in said Fractional Block
<br />Eleven (11), both being additions to the City of Grand Island, Hall County,
<br />Nebraska
<br />together with all the hereditaments and appurtenances thereunto belonging.
<br />To have and to hold the above - described property unto the Grantee, its successors
<br />and assigns.
<br />This conveyance is made pursuant to the powers conferred on said Trustee by that
<br />certain deed of trust executed effective August 15, 2002 by Galen B. McHugh, as Trustor,
<br />to First National Acceptance Company, as Trustee and Beneficiary, recorded on December
<br />26, 2002, in the office of the Register of Deeds of -Hall County, Nebraska, as Instrument
<br />No. 2002 -14437 of the Mortgage Records, to secure the payment of one certain real estate
<br />balloon note in the original sum of $40,376.96 and interest, as therein provided (the "Deed
<br />of Trust ").
<br />Default has occurred under the terms of the Deed of Trust and the obligations
<br />secured thereby, as more particularly set forth in the Notice of Default recorded on
<br />February 13, 2004, in the office of the Register of Deeds of Hall County, Nebraska, as
<br />Instrument No. 0200401289 of the Miscellaneous Records (the "Notice of Default ").
<br />On February 19, 2004, copies of the Notice of Default, with the recording data
<br />shown thereon, were mailed to the Trustor and all interested parties by certified mail, return
<br />receipt requested, postage prepaid, to the addresses shown in the Deed of Trust.
<br />After the lapse of not less than one (1) month, Martin P. Pelster, Successor Trustee,
<br />in consequence of the Notice of Default and in compliance with the terms of the Deed of
<br />Trust, did execute a Notice of Trustee's Sale, stating that the above - described property
<br />would be sold at public auction to the highest bidder for cash on the lower level lobby of
<br />the Hall County Courthouse, at 1st and Locust Streets in Grand Island, Hall County,
<br />Nebraska, on the 14th day of May, 2004 at 10:00 a.m. The Notice of Trustee's Sale was
<br />published in the Grand Island Island Independent, a newspaper having general circulation in Hall
<br />County, Nebraska, with the first publication being made on March 30, 2004, and thereafter
<br />on April 6, 2004, April 13, 2004, April 20, 2004 and April 27, 2004.
