99 111307 <br /> EASEMENT <br /> THIS EASEMENT is made and entered into ��rhU�� �q , <br /> 1999, by and between Charles McDonald and Betty J. McDonald, <br /> husband and wife ( "Grantor") , for the benefit of George W. Foster, <br /> Domiciliary Foreign Personal Representative of the Estate of Carl <br /> W. Foster, Deceased, James F. Foster and Carol Foster, husband and <br /> wife ( "Grantee" ) . <br /> WHEREAS, Grantor is the owner of the real estate legally <br /> described as : <br /> Lots Four (4) , Five (5) , Six (6) , Seven (7) and Eight <br /> (8) , and the Northwest Quarter of the Southeast Quarter <br /> (NW 1/4 SE 1/4) , and the South Half of the Southwest <br /> Quarter (S 1/2 SW 1/4) of Section Fifteen (15) , Township <br /> Ten (10) North, Range Nine (9) West of the 6th P.M. , in <br /> Hall County, in the State of Nebraska, except that part <br /> thereof conveyed to the State of Nebraska described in <br /> deed recorded in Book 71 on Page 158 of Deed Records in <br /> the Office of the Register of Deeds of Hall County, <br /> Nebraska, and subject to existing public roads and <br /> easements of record or apparent upon inspection, <br /> hereafter referred to as "Grantor' s estate" ; and, <br /> WHEREAS, Grantee is the owner of the real estate legally <br /> described as : <br /> Lots One (1) , Two (2) and Four (4) , Island, Section <br /> Fourteen (14) ; and Lots Ten (10) and Eleven (11) , Island, <br /> Section Eleven (11) ; all in Township Ten (10) North, <br /> Range Nine (9) West of the 6th P.M. , in Hall County, <br /> Nebraska, EXCEPTING THEREFROM a tract of land described <br /> in Warranty Deed filed September 30, 1999, as Document <br /> No. 99-109646 in the Hall County Register of Deeds <br /> Office, <br /> hereafter referred to as "Grantee' s real estate" ; and <br /> WHEREAS, it is necessary for Grantee, their successors in <br /> interest, assigns, and invitees to travel across Grantor' s estate <br /> to get access to Grantee' s estate, Grantee' s estate being "land- <br /> locked" ; and <br /> WHEREAS, Grantor has agreed in consideration of the sum of Two <br /> Thousand Dollars ($2, 000 . 00) to be paid to Grantor by Grantee, to <br /> grant to Grantee an easement upon part of Grantor' s estate for the <br /> purpose as set forth herein. <br />
