<br />of recorded on May 24, 1999 as Instrument No.
<br />Mortgage Records in the office of the Register
<br />99- 103029 of the
<br />of Deeds of Hall County, Nebraska, and
<br />Association N.D., hereinafter called "Grantee":

<br />WHEREAS, on February 6, 2004, Eric H. Lindquist, as Successor Trustee, executed a Notice of
<br />Default pursuant to which notice was given to Frank R. Spulak, a single person, Trustor, under that certain
<br />Deed of Trust recorded on May 24, 1999 as Instrument No. 99- 103029 of the Mortgage Records in the
<br />office of the Register of Deeds of Hall County, Nebraska, covering that certain premises described as:
<br />LOT SIX (6) EXCEPT THE NORTHERLY SIXTY (60) FEET THEREOF AND ALL
<br />OF LOT FIVE (5), BLOCK SEVEN (7), SOUTH GRAND ISLAND, AN ADDITION
<br />TO THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting forth the
<br />nature of such breach and of his election to sell or cause to be sold such property to satisfy the obligation.
<br />Said Notice of Default was filed for record in the Office of the Register of Deeds of Hall County, Nebraska,
<br />on February 9, 2004 as Instrument No. 2004-0113 8 of the Miscellaneous Records of said County.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice pursuant to
<br />said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on March 26, 2004, Grantor caused to be published in the Grand
<br />Island Daily Independent, a newspaper having a general circulation in Hall County, Nebraska, a Notice of
<br />Trustee's Sale setting forth a description of the property to be sold and stating that the described property
<br />would be sold at public auction to the highest bidder for cash or certified or cashier's check, at the lower
<br />level lobby of the Hall County Courthouse, 1St & Locust Street, Grand Island, Hall County, Nebraska, at
<br />10:00 a.m. on May 6, 2004. Publication of such notice was made for five consecutive weeks on March 26,
<br />2004, April 2, 2004, April 9, 2004, April 16, 2004 and April 23, 2004, the last publication being at least ten
<br />(10) days but not more than thirty (3 0) days prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties entitled to
<br />notice pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Pursuant to said Notice of Trustee's Sale, John B. McDermott, attorney for Eric H. Lindquist,
<br />Successor Trustee, did at the time and place mentioned in said Notice of Trustee's Sale, offer said property
<br />for sale at public auction, and did sell the same to Grantee for the sum of $44,965.00, it being the highest
<br />bidder therefor.
<br />NOW, THEREFORE, in consideration of the premises and of the sum of $44,965.00 so bid and
<br />paid as aforesaid, I, Eric H. Lindquist, Successor Trustee, do hereby grant and convey unto said Grantee, its
<br />successors and assigns forever, all the estate, right, title and interest of which the said Frank R. Spulak, a
<br />single person, and his successors in interest, were seized or possessed at the time said Deed of Trust was
<br />given, or at any time thereafter, in and to the premises sold as aforesaid, to -wit:
<br />LOT SIX (6) EXCEPT THE NORTHERLY SIXTY (60) FEET THEREOF AND ALL
<br />OF LOT FIVE (5), BLOCK SEVEN (7), SOUTH GRAND ISLAND, AN ADDITION
<br />TO THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA.
