Additionally, Trustor hereby <br />requests that Trustee shall mail Trustor a copy of any Notice of Default and Notice of Sale <br />hereunder upon default addressed to it at Box 434, Doniphan, Nebraska 68832. Out of the <br />proceeds of said sale, the Trustee shall retain and pay first all fees, charges, and costs of <br />sale, and all monies advanced in the exercise of the power of sale, including the payment of <br />the Trustee's fees actually incurred, and pay second the obligations secured by this Deed of <br />Trust; and the balance, if any, shall be paid to the person or persons legally entitled thereto. <br />Any person, including the Beneficiary, may purchase said property at such sale. <br />The Trustor covenants that at the time of delivery of these presents, it is seized of <br />said property in fee simple, and that said property is free of encumbrances, except <br />easements, rights -of -way, restrictions and reservations of record, and it will properly <br />maintain the property, keep all buildings insured for fire and extended coverage in an <br />amount equal to the unpaid balance of the aforesaid Note, with loss payable to the <br />Beneficiary, and will pay all taxes and assessments against said property and if they shall <br />fail to pay insurance premiums or taxes, the Beneficiary may pay the same, and all amounts <br />so paid shall become additional indebtedness due hereunder; and in case of foreclosure or <br />other proceedings to which the Trustor shall be a party, Trustor will pay any reasonable <br />attorney fees (not to exceed 2 %) incurred by Beneficiary or Trustee in such foreclosure or <br />other proceedings to the extent permitted by applicable law. <br />Trustor shall furnish Beneficiary written proof on January 1 and July 1 of each year <br />that the insurance is in full force and effect. <br />Should the Beneficiary hereunder be made a party to any action affecting this Deed <br />of Trust or the title to said property, the Trustor agrees that all court costs and a reasonable <br />attorney fee (not to exceed 2 %) paid by the Beneficiary shall become additional <br />indebtedness due hereunder, and the Trustor hereby releases and waives all claims to said <br />property as a homestead exemption or other exemption now or hereafter provided by law. <br />It is agreed that in case of a sixty (60) day default in payment of said principal or <br />interest or a breach of any of the covenants herein, then said principal sum hereby secured <br />and interest thereon may, at the option of the Beneficiary, become due and payable at once. <br />Anything in said Note and this Deed of Trust to the contrary notwithstanding, upon default, <br />the Beneficiary shall be entitled to immediate possession of said property, together with the <br />rents, issues and profits therefrom, and on failure of Trustor to deliver such possession, the <br />Beneficiary shall be entitled to a receiver for said property that may be appointed by any <br />court of competent jurisdiction. <br />All the covenants herein shall be binding upon the respective heirs, personal <br />Q� <br />2 <br />
