<br />You are hereby given notice of default under a Deed of Trust
<br />executed by Elvia Galaviz, a single person, dated October 9, 2001,
<br />and recorded October 10, 2001, as Document No. 200110169 in the
<br />Office of the Register of Deeds of Hall County, Nebraska; said Deed
<br />of Trust securing the following property:
<br />The Easterly Forty -Seven Feet (E471) of the Southerly Eighty
<br />Feet (S801) of Fractional Lot Nine (9) in Fractional Block
<br />Nineteen (19) in H.G. Clark's Addition to the City of Grand
<br />Island, Hall County, Nebraska, and its complement: Fractional
<br />Lot Eight (8) in Fractional Block Six (6) in Rollins' Addition
<br />to the City of Grand Island, Hall County, Nebraska, being a
<br />rectangular tract of ground having a Southerly frontage of
<br />Forty -Seven Feet (471) on Sixth Street, in said City, and a
<br />depth of Eighty Feet (801),
<br />said Deed of Trust being in favor of James A. Wagoner, Attorney at
<br />Law, Trustee, and Doyle L. Winfrey and Violet B. Winfrey,
<br />Beneficiary under said Deed of Trust. That a Substitution of
<br />Trustee was subsequently executed by Doyle L. Winfrey and Violet B.
<br />Winfrey naming John M. Cunningham as Successor Trustee, said
<br />Substitution of Trustee dated April 30, 2004, and recorded May 3,
<br />2004, as Document No. 0200404236 in the Office of the Register of
<br />Deeds of Hall County, Nebraska.
<br />Said default under the terms of said Deed of Trust has
<br />occurred by virtue of nonpayment of the payments as they became due
<br />and payable under a Promissory Note dated October 9, 2001, for the
<br />months of March and April, 2004, in the sum of Four Hundred Dollars
<br />($400.00) per month (principal and interest), and that on May 1,
<br />2004, there was currently due and owing the principal sum of Forty -
<br />Nine Thousand Sixty -Nine Dollars and One Cent ($49,069.01),
<br />together with unpaid interest as of May 1, 2004, in the sum of Five
<br />Hundred Seventy -One Dollars and Eighty -One Cents ($571.81).
<br />In addition, Trustors are hereby liable to the Successor
<br />Trustee, John M. Cunningham, for all fees and costs associated with
<br />this default and recovery pursuant to Nebraska Statute § 76 -1012.
<br />By virtue of said default, Successor Trustee, John M.
<br />Cunningham, has determined to sell or cause to be sold the trust
<br />property to satisfy the obligations referred to above.
<br />The default may be cured within thirty (30) days of the filing
<br />of this Notice, and the obligations of the Deed of Trust may be
<br />thereby reinstated as provided in Nebraska Statute § 76 -1012.
