<br />This instrument, made thisa23 day of April, 2004, between Eric H. Lindquist, a member of
<br />the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ", pursuant to a
<br />power of sale contained in that certain Deed of Trust recorded on March 23, 2001 as Instrument No.
<br />2001 -02363 of the Mortgage Records in the office of the Register of Deeds of Hall County,
<br />Nebraska, and the Secretary of the Department of Veterans Affairs, hereinafter called "Grantee ":
<br />WHEREAS, on January 27, 2004, Eric H. Lindquist, as Successor Trustee, executed a
<br />Notice of Default pursuant to which notice was given to Sean P. Bragg, a married man and Melissa
<br />A. Bragg, his wife, Trustors, under that certain Deed of Trust recorded on March 23, 2001 as
<br />Instrument No. 2001 -02363 of the Mortgage Records in the office of the Register of Deeds of Hall
<br />County, Nebraska, covering that certain premises described as:
<br />The East 100 feet of Lot Two (2) of the County Subdivision of Part of
<br />the South half (S1 /2) of Section Five (5), in Township nine (9) North,
<br />Range Nine (9) to Doniphan, Hall County, Nebraska and a north
<br />extension of 14 feet being a part of the Southwest Quarter of the
<br />Southeast Quarter (SW1 /4SE1/4) of Section Five (5), the whole making
<br />a rectangular piece of ground having a frontage of 100 feet on the South
<br />line of said Section and a depth of 195 '/z feet,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on February 6, 2004 as Instrument No. 2004 -01074 of the Miscellaneous
<br />Records of said County.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on March 11, 2004, Grantor caused to be published in the
<br />Grand Island Daily Independent, a newspaper having a general circulation in Hall County,
<br />Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and stating
<br />that the described property would be sold at public auction to the highest bidder for cash or certified
<br />or cashier's check, at the lower level lobby of the Hall county Courthouse, 1St & Locust Street,
<br />Grand Island, Hall County, Nebraska, at 2:00 p.m. on April 21, 2004. Publication of such notice
<br />was made for five consecutive weeks on March 11, 2004, March 18, 2004, March 25, 2004, April
<br />1, 2004 and April 8, 2004, the last publication being at least ten (10) days but not more than thirty
<br />(30) days prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to, notice pursuant to said Deed of Trust and in compliance with Section 76 -1008
<br />R.R.S. Nebraska.
<br />Pursuant to said Notice of Trustee's Sale, Arend R. Baack, attorney for Eric H. Lindquist,
<br />Successor Trustee, did at the time and place mentioned in said Notice of Trustee's Sale, offer said
<br />property for sale at public auction, and sold the same to Navy Federal Credit Union for the sum of
