<br />This Declaration made this day of April, 2004, by Ward F. Hoppe, Manager of Walnut Redevelopment, LLC, as
<br />general partner of Walnut Housing, Ltd., Grantor, herein after called the ( "Declarant "), for itself, its successors, grantees and assigns.
<br />WITNESSETH:
<br />1. Declaration of Purpose. The purpose of this Declaration is to submit the land herein described together with all
<br />easements, rights and appurtenances, and improvements thereon, ( "Property") to the condominium form of ownership and use in the
<br />manner established by Sections 76 -825 to 76 -894 Neb. Rev. Stat. ( "Nebraska Condominium Act ") under and in accordance with the
<br />terms of the Declaration of Condominium filed on December 12, 2003 and found as Instrument number 200315961 in the offices
<br />of the Register of Deeds of Grand Island, Hall County, Nebraska.
<br />2. Property Submitted.
<br />A. The real estate owned by said Grantor which is hereby submitted to the Condominium is described as follows:
<br />Lot 1, Block 8, Rollins Addition to the City of Grand Island, ]-Tall County, Nebraska, together with the Northerly Half of vacated alley
<br />abutting said lot on the South; Lot 10, Block 8, Rollins Addition to the City of Grand Island, Hall County, Nebraska together with
<br />the Southerly half of the vacated alley abutting said lot on the North; Fractional Lot 10, in Fractional Block 8, Rollins Addition to
<br />the City of Grand Island, Hall County, Nebraska; All that part of Cleburn Street (now vacated), lying between the north line of Fifth
<br />Street and the south line of Sixth Street in the City of Grand Island, Hall County, Nebraska; Fractional Lot 4, Block 13, Original
<br />Town, now City of Grand Island, Nebraska, and its complement Fractional Lot 4, Fractional Block 7, Rollins Addition to the City
<br />of Grand Island, Hall County, Nebraska; Lots 1, 2, 3, 5, 6, 7 and 8, Block 13, Original Town of Grand Island, Hall County, Nebraska;
<br />All that part of the alley (now vacated) in Block 13, Original Town, now City of Grand Island, Hall County, Nebraska, lying between
<br />the Easterly line of vacated Cleburn Street and the Westerly line of Elm Street.
<br />B. The improvements which are hereby submitted include the "Walnut School' on the real estate
<br />described in paragraph (A) above as partially reconstructed into the units, together with the parking lot and
<br />landscaping as partially completed upon the land described in (A) above and all improvements, additions,
<br />refinements and renovations to such real estate pursuant to the renovation plans for the property attached hereto.
<br />The purpose of this supplemental declaration is to assure all of the foregoing real estate is subject and a
<br />party of Old Walnut, a Condominium.
