Martinez, A Sin$le Person, - <br />hereinafter referred to as "Borrower ", and EQUITABLE FEDERAL SAVINGS BANK OF <br />GRAND ISLAND, hereinafter referred to as "Lender ". <br />WITNESSETH: <br />m_ "EREAS, Borrower did execute a certain Note payable to the order of the Lender in <br />the original�amount of Four Hundred Fifty Thousand and No /100 Dollars <br />450,,000.00 , dated October 16 20 03 ; <br />WHEREAS, the Note described above was secured by a Deed of Trust dated <br />October 16 , 20 03 " filed of record in the Office of the Hall County (Register of <br />Deeds) (Clerk) on October 16 20 03 , (as Document No. 0200313704 (as <br />Instrument No. ) (in Book of , at Page ) in respect to that real <br />estate described as: <br />Parcel 1: Lot Two (2), Toukan 4`h Subdivision to the City of Grand Island, Hall County, Nebraska. <br />Parcel 2: Lot Eight (8), Block Three (3), Spaulding & Gregg's Addition to the City of Grand Island, <br />Hall County, Nebraska. <br />Parcel 3: The East Sixty Feet (E60') of Lot One (1), Block Three (3), Spaulding & Gregg's Addition <br />to the City of Grand Island, Hall County, Nebraska. <br />WHEREAS, such Deed of Trust provides that it is to secure future advances; <br />WHEREAS, Borrower has requested additional funds be advanced which are to be <br />secured by such Deed of Trust; <br />WHEREAS, in the event the sum hereby requested shall exceed the sum of future <br />advances originally provided for in such Deed of Trust, then such Deed of Trust shall hereby be <br />deemed amended to fully secure the entirety of the indebtedness hereinafter set forth <br />notwithstanding any limitation on the amount of the future advance specified in such Deed of <br />Trust; <br />WHEREAS, Lender is willing to advance additional funds to Borrower to be secured by <br />such Deed of Trust; <br />WHEREAS, Borrower and Lender hereby desire to amend the existing Deed of Trust <br />identified hereinabove to extend its maturity by reason of the execution and delivery of a new <br />Note evidencing the replacement of the original Note as well as the advance of funds <br />contemplated herein; <br />NOW, THEREFORE, it is agreed: <br />1. Security for New Instrument of Indebtedness. The indebtedness described in the Deed <br />of Trust identified above, shall from the date hereof secure a Note in the amount of <br />Five Hundred Thousand and No /100 Dollars ($ 500 000.00 of even date <br />herewith, together with all renewals, modifications and extensions thereof and any and all future <br />advances'and re- advances thereof. <br />2. Modification of Date of Stated Maturity. The Maturity Date in respect to the <br />indebtedness to be secured the Deed of Trust hereby modified is extended from <br />04 -15 -04 to 04 -15 -19 . <br />rn <br />C <br />(D <br />
