Nahrstedt, a single <br /> person, and the owner of TRACT I: <br /> Lot Ten(10), Block Three (3), Better Homes Subdivision, <br /> City of Grand Island, Ha11 County,Nebraska, <br /> hereinafter referred to as Nahrstedt;and Kenneth W. Howell and Tammera S. <br /> Howell, each in his and her own right, and as spouse of each other, still as joint <br /> tenants, and the owners of TRACT II: <br /> Lot Eleven(11),Block Three (3), Better Homes Subdivision, � , <br /> City of Grand Island, Hall County,Nebraska, � <br /> hereinafter referred to as Howell. <br /> I. <br /> It is agreed between Nahrstedt and Howell that the double garage and joint <br /> driveway furnishing ingress and egress thereto, which garage and�riveway are <br /> situated partially on TRACT I and partially on TRACT II, aze for the use of said <br /> two tracts on the following basis: <br /> A. The South half of the garage is the exclusive property of Nahrstedt, <br /> and the North half of the garage is the exclusive property of <br /> Howell. <br /> B. Either of the parties may use the joint driveway for ingress and <br /> egress to and from their respective portion of said garage and will <br /> not unreasonably block the use by the other of such joint driveway. <br /> C. The parties agree to maintain and repair the driveway and garage in <br /> good condition, and each party and successors shall be responsible <br /> for maintenance and repair of the portion of the driveway and <br /> garage which is on the portion of the lot owned by each. <br /> II. <br /> Any utility lines crossing either TRACT I or TRACT II for the benefit of the other <br /> are hereby recognized as easements for the benefit of such tract so served. The <br /> owner of the tract so served shall have the continued benefit of such utility line and <br /> may, as reasor�ably needed, repair or replace such line from time to time disturbing <br /> the burdened tract as little as possible and restoring the surface of the burdened <br /> tract and protecting the burdened tract in any such repair or replacement, all at the <br /> e��pense of the benefited tract. <br /> III. <br /> This agreement shall ru.n with the land and inure to the benefit of the successors in <br /> title to the respective tracts. <br /> Page 1 of 2 <br /> � <br />
