A A h n _ .� rq M 3 r it M 2 W CD 1 N v CONTRACT FOR PURCHASE (Trustee's Original) .: `� THIS CONTRACT FOR PURCHASE, made and entered into as of the first day of April 2004, by �dl and between CENTRAL COMMUNITY COLLEGE FACILITIES CORPORATION, a not for profit the laws of the State of Nebraska (the "Vendor "), and the corporation duly organized and existing under COMMUNITY COLLEGE AREA in the State of Nebraska (the "Purchaser" or the "College "), CENTRAL WITNESSETH: That Purchaser is a community college area and a body corporate governed by the Community College Board of Govemors for the Central Community College Area (the `Board") and organized and existing under Article 15, Chapter 85, R.R.S. Neb. 1999 with full, lawful power and authority to enter into this Contract for Purchase, as a purchase on contract pursuant to the authority granted by Section 85 -1511, R.R.S. Neb. 1999, for which approval has been received from the Coordinating Commission for Postsecondary Education; Purchaser owns and operates certain educational facilities (the "Facilities ") located in Hall County, Nebraska, and desires to acquire improvements and equipment for an existing building (the `Building ") located on the land (the "Site') described in Exhibit A hereto attached, which is by such reference incorporated herein, for use as a distance learning center (the "Project') and has by separate instrument granted Vendor an easement for contraction, installation, location, maintenance and operation of the Project on the Site; Vendor has been organized and exists for the purpose of acquiring and improving real and personal property for use by he College in connection with its educational programs; Vendor and Purchaser have agreed upon the terms of a Contract for Purchase to provide for the acquisition of the used in this Contract for tPu and to the following meaning, nless hthe ontext or use indicates at s another or different meaning or intent: "Bond Fund" shall mean the fund created by Article V of Indenture into which basic payments under this Contract for Purchase shall be deposited. "Bonds" or `Building and Equipment Bonds" shall mean the Building and Equipment Bonds (Grand Island Distance Learning Project), Series 2004, issued by Vendor pursuant to the Indenture to provide funds for construction and acquisition by Vendor of the "Project".
