200403825 <br />Trust Indenture and Security Agreement and the rights hereby granted shall cease, determine and be void; <br />otherwise this Trust Indenture and Security Agreement to remain in full force and effect. <br />THIS TRUST INDENTURE AND SECURITY AGREEMENT FURTHER WITNESSETH: That <br />all Bonds issued hereunder are to be issued, authenticated and delivered, and all said revenues, income and <br />other property hereby pledged are to be dealt with and disposed of under, upon and subject to the terms, <br />conditions, trusts, uses and purposes hereinafter expressed, and the Corporation has agreed and covenanted <br />and does hereby agree and covenant with the Trustee and with the respective owners, from time to time, of <br />the Bonds, as follows, that is to say: <br />ARTICLE I <br />DEFINITIONS <br />Section 1. In addition to the words and terms elsewhere defined in this Indenture, the following <br />words and terms as used in this Indenture shall have the following meanings, unless the context or use <br />indicates another or different meaning or intent: <br />"Bond" or "Bonds" - any bond or bonds issued pursuant to, in accordance with and <br />secured by this Indenture. <br />"Bond Fund" - the Fund created by Article V of the Indenture into which the funds <br />specified in Article V are to be deposited. <br />"Building" — the existing building of the College which is to be remodeled, previously <br />used for administrative space and to be used for distance learning programs as shown on Exhibit <br />A hereto attached. <br />"Building and Equipment Bonds" - the $880,000 of Building and Equipment Bonds <br />(Grand Island Distance Learning Project), Series 2004, issued hereunder. <br />"College" - Central Community College Area, in the State of Nebraska. <br />"Construction and Acquisition Fund" the Construction and Acquisition Fund <br />established with the Trustee under the terms of Section I of Article VI of this Indenture. <br />"Corporation" - Central Community College Facilities Corporation, a Nebraska not - <br />for- profit corporation. <br />"Easement Agreement" - that License and Easement by the College in favor of the <br />Corporation granting certain rights with respect to the Building as located on the real estate <br />described on Exhibit A hereto attached. <br />W <br />
