200403825 Trust Indenture and Security Agreement and the rights hereby granted shall cease, determine and be void; otherwise this Trust Indenture and Security Agreement to remain in full force and effect. THIS TRUST INDENTURE AND SECURITY AGREEMENT FURTHER WITNESSETH: That all Bonds issued hereunder are to be issued, authenticated and delivered, and all said revenues, income and other property hereby pledged are to be dealt with and disposed of under, upon and subject to the terms, conditions, trusts, uses and purposes hereinafter expressed, and the Corporation has agreed and covenanted and does hereby agree and covenant with the Trustee and with the respective owners, from time to time, of the Bonds, as follows, that is to say: ARTICLE I DEFINITIONS Section 1. In addition to the words and terms elsewhere defined in this Indenture, the following words and terms as used in this Indenture shall have the following meanings, unless the context or use indicates another or different meaning or intent: "Bond" or "Bonds" - any bond or bonds issued pursuant to, in accordance with and secured by this Indenture. "Bond Fund" - the Fund created by Article V of the Indenture into which the funds specified in Article V are to be deposited. "Building" — the existing building of the College which is to be remodeled, previously used for administrative space and to be used for distance learning programs as shown on Exhibit A hereto attached. "Building and Equipment Bonds" - the $880,000 of Building and Equipment Bonds (Grand Island Distance Learning Project), Series 2004, issued hereunder. "College" - Central Community College Area, in the State of Nebraska. "Construction and Acquisition Fund" the Construction and Acquisition Fund established with the Trustee under the terms of Section I of Article VI of this Indenture. "Corporation" - Central Community College Facilities Corporation, a Nebraska not - for- profit corporation. "Easement Agreement" - that License and Easement by the College in favor of the Corporation granting certain rights with respect to the Building as located on the real estate described on Exhibit A hereto attached.
