<br /> IN THE MATTER OF CASE NO. BK99-40645
<br /> CHAPTER 7
<br /> JAMES A. SWANSON, II,
<br /> DEBTOR.
<br /> KNOW ALL MEN BY THESE PRESENTS THAT:
<br /> WHEREAS, a voluntary Petition in Bankruptcy was filed by James A.
<br /> Swanson, II, hereinafter referred to as "Debtor" , whether one or more, in the
<br /> United States Bankruptcy Court for the District of Nebraska on the lst day of
<br /> April, 1999, and said Debtor was duly adjudged bankrupt on the 16th day of
<br /> June, 1999; and
<br /> WHEREAS, on the 2nd day of April, 1999, by Order of said Court the
<br /> undersigned was appointed Trustee of the estate and effects of said Debtor
<br /> and is duly qualified and is now acting as such Trustee; and
<br /> WHEREAS, the Trustee has given notice to creditors on the 6th day of
<br /> August, 1999, of his intention to sell property at private sale; and
<br /> WHEREAS, since no creditors have filed objections to said sale on or
<br /> before August 31, 1999, with the Bankruptcy Clerk, this Trustee is hereby
<br /> authorized to sell at private sale to First Commerce Bancshares, Inc . ,
<br /> hereinafter referred to as "Buyer" , whether one or more, for the amount of
<br /> FIVE THOUSAND AND NO/100 DOLLARS, ($5, 000 . 00) , the following described
<br /> property, to-wit :
<br /> The West Three Feet and Two and Three Quarters Inches
<br /> (W3 ' 2 3/4" ) of Lot Four (4) and all of Lots Five (5) and
<br /> Six (6) , Block Twenty-five (25) in the Original Town of
<br /> Wood River, Hall County, Nebraska, and part of vacated
<br /> North Street as shown in Ordinance No. 21, recorded in
<br /> Book "N" , Page 660 .
<br /> NOW, THEREFORE, I , the undersigned Trustee in Bankruptcy of said Debtor,
<br /> by virtue of the powers vested in me by the Bankruptcy Act and by virtue of
<br /> said Notice and pursuant to said application and for other valuable
<br /> consideration, do hereby grant, bargain, sell and convey to the said Buyer,
<br /> its representatives, heirs and assigns forever, all my right, title and
<br /> interest as such Trustee, free from encumbrances, except for easements,
<br /> covenants and restrictions of record.
<br /> TO HAVE AND HOLD said property to the said Buyer, its representatives,
<br /> heirs and assigns forever, as fully and completely as I , the undersigned as
<br /> such Trustee, by virtue of said Notice confirming the sale thereof and of the
<br /> Bankruptcy Act might or should sell and convey the same.
<br /> The Trustee makes no representations or warranties herein and this
<br /> Trustee' s Deed is without recourse against said Trustee either individually
<br /> or as such Trustee.
<br /> IN WITNESS WHEREOF, I, the said Trustee in Bankruptcy, have hereunto set
<br /> my hand this 3rd day of September, 1999 .

<br /> Trustee' s Deed, and he acknowledged his execution thereof to be his voluntary
<br /> act and deed as such Trustee for the purposes the in set forth.
